    its a really good discussion, thanks to all people who have provided valuable information. I am a Consultant throughout my career and never lead a team but now planning to change gears and move into project management. When I goolged about the requirement to take the exam, Lot of PMP training institutes came up and they are charging about $2000 for training and they say its a 5 day course, guarantee to pass bhla bhla .... My first question is it required to take these training classes? if not how to become eligible for to take the exam, Please advice.

    Note sure what you're looking for. The memo I cited went into effect on June 16th. If that's not what you're looking for, you can try "press room" at USCIS's website where all memos are listed by date.

    I tried CIS press room, but couldn't find it. And i'm sure that about couple of weeks back i saw that memo (which states if initial evidences are not present, they might reject/deny a case without RFE). It was posted on this board and now its very hard to search with few words.

    This thread seems to express my thoughts.
    I used to wait till my dates got current. With my dates being current since November, I still wait with no sign of improvement.
    I tried calling the 1-800 number. But, did not get any useful information.
    Took an Infopass appointment couple of weeks back. But, it was of no use.
    The officer at the local office read the same status that I see online.
    She said that my case was transfered to Texas center. (I knew this since October 2007). Only additional information she gave me was that my namecheck got clreared. (Though this is important, I dont think this really matters to get my case processed).

    I told her that I have been waiting since years and some of friends who filed later than me already got their GCs, she felt sorry for me but she said there is nothing she can do for me. Not even a Service Request since my dates are within the processing times.

    Its getting difficult for me......Also, in this economy its getting tough everyday to hold on to the job. Who knows may be this year quota might be over too. It will definitely be a big relief if we get the GC.
    I thought there is nothing I can do now till my dates goes outside the processing times. Please advice.

    Similar situation here...applied EAD/AP renewals 1st week of May at NSC for self and spouse. So far only my EAD has been approved, which is pretty much of no use to me since i am on H1B - but employer was paying all costs, so the law firm applied it anyway.

    Spouse needs EAD ASAP before expiry, but nothing yet. I want to modify wht u quoted below:

    "USCIS won't give u what u want" I think they somehow have an idea of how desperate u r for someting and ur processing/wait time is proportional to your desperation. :-)

    E-filed on May 5th, FP on June 6th, no updates since. Concerned as I'm working on EAD and current one expires August 29th.

    Paper filed AP in late June, approved already (as per e-mail) even though I only needed it in mid October!!

    Just like the the old Stones song... "You can't always get what you want"

    I guess most of the folks here are busy preparing to apply for 485. I have different problem here.

    My employer's attorney is charging me outrageous fees of around $5000 to
    apply for 485, AP and EAD for me and my spouse. This excludes USCIS fees. I work on hourly basis, so I should be taking care of immigration fees. My employer is not allowing me to file through another law firm.

    Do I have any other options. How much do they charge usually.


    Same with me My current attorney increased the fee overnight and luckily my employer is ready to work with others. find another one today and sent all the documents ( my 140 was already approved and available with me ) ..Dont want to take any risk with the 485 filing .....so hired another attorney

    I agree with Munna Bhai on this. There is no need to put salt on the wound , we should help if we can on the issue in hand instead of judging others.


    Were you witness to what happened in his home on that day?? If not, don't be judgemental....leave that to him and his wife and to family court. IV is not for "every good cause"...we are having very difficult time ourself...

    Looks like you already received GC and you have great & lot of time to get into other issue.

    In that case, at least you will have your EAD and AP and can change your blood sucking deshi consulting company after 180 days and can peruse better employment opportunities.

    Lost in the big hoopla of 1 yr jump and hopes of similar advancement for others in May VB are the following facts.

    1. USCIS is about to raise fees for all immigration related procedures beginning from June 1st
    2. Visa quota ends in September and it takes on an average of 4-6 months to process I-485.
    Let me detail 2nd step. If they move dates forward by say 1 yr and thousands become eligible for 485. They will accept those cases, get fees from those lucky souls and make the dates unavailable after 1-2 months. Remember last year they were moving dates by 6 months till they made it UNAVILABLE for August and September.

    I spent 5 full years in Canada from 1995 2 of which I did my MS (in Montreal - Quebec) and 3, I worked for one of Canada's largest software companies in Ottawa - Ontario. Over the course of these 5 years, I acquired both my Canadian green card and Canadian Citizenship..

    From 2000 onwards, I have been in the US languishing in this stupid EB Green Card queue...

    I originally hail from India, so can give some clear opinons on how life is comparatively in all three places.

    I will firstly agree with someone who mentioned that rather than considering Canada as an option 2 after the US, one should consider our home country..honestly, I believe our home country should be the no. 1 priority on our list. The real solution to all immigration problems lies in the balancing of economies on a global scale...and we as the H1-B skilled workforce are the best people for making the Indian/Chinese economies move forward....reduce unemployment there and improve the wage standards...

    As for Canada, except for the cold, almost everything about Canada is better than the US in my opinion - better quality of life, better social security, better health care, safer neighborhoods, better education, better immigration system etc. etc..if you hail from a tropical place like India, the cold WILL bother you, though....

    Montreal is 50% English/50% French, and I had no problems living in Montreal although, I know nothing about French at all..

    From a pure money stand point of view, it is true, that you will somewhat make more money in US, but most of that will be offset by the higher healthcare costs and higher housing costs...

    Frankly, if this 6+ year wait on the US Green Card doesn't go anywhere, I will definitely consider moving back to India, rather than Canada...in 2007 or so...because, I feel, I have spent enough years away from India, accrued enough wealth and owe my time and energy to building the Indian economy....rather than giving my years to any of the western countries....that already are well developed...

    But consider this: I just posted this in the approval thread:

    Looking at the overall approval trend in IV, , Murthy forum etc it is clear to me that FIFO is out of the door and in most likelihood low hanging fruit is being plucked from the tree. At the next Ombudsman call I am going to raise the issue of USCIS's declared commitment to FIFO but actions that seem completely contrary to it.

    Obviously anonymous postings in open forums cannot be presented as evidence but one can certainly request the Ombudsman's office to ask for monthly 485 approval statistics and the cat will be out of the bag. By the time the wheels of Goverment bureaucracy move it might be a month or two before this data is made available to the Ombudsman's Office; forget the applicants - that will be like asking for the moon.

    Regardless of whether I get approved or not in the next month or two; from a process perspective a monthly approval report going from the USCIS to the Ombudsman's Office each month should hopefully force them to stop this stonewalling and walk the talk.

    This will not only help EB2s down the line but spare a thought for next year when EB2 is current, EB3 has a cut off of June 1, 2006 and we start seeing May 2006 EB3 approvals when 2001/02 EB3s are still pending. Again I welcome suggestions but the focus of my effort is going to be the approval process rather than a personal case or two.

    Good idea delax. I support this action.

    I understand you don�t care about the United States and its people and you�re only interested in what you can gain from them but if you weren�t so blinded by greed you�d see this is something else they can give to you. Now I know why I took the route I did, I would have accomplished far less in my personal life with the likes of you. In fact, I may doing to much sharing my expertise with you. I refuse to have my name tarnished any further. Besides, you�re only a beginner. What was I thinking? IV really ought to make it clear to everyone that this is an amateur site. Maybe by changing its name to Beginning Immigration. IV definitely is not the voice of Immigration � my voice is different from IVs and I�m dealing with immigration. I may have to contact the internet higher-ups about this farse.

    Basically we dont care or support illegals and drug traficers. if you are innocent, go to court and fight your rights. Now get lost

    This MEMO also talks about length of stay beyond 6 years. There has been a lot of controversy involving changing job after 3 years H1B extension based on approved I-140. This memo seems to clarify that a little, but it is still not clear enough about implication of revoked I-140 on the approved H1B.

    See Section 5, Page 7

    Burden of proof rests with petitioner and alien to establish his or her eligibility....

    I hope some lawyer or USCIS can clarify this once and for all. There are already so many thereads on this, that I don't want to start another one.
