In addition to sending the letter, we may try this avenue as well (look at the page bottom)
How to Contact Us (http://travel.state.gov/about/info/info_308.html)
"For immigrant visa inquiries, call the National Visa Center at 603-334-0700 or
email: NVCINQUIRY@state.gov"
Any idea if these is the correct number to call ?
Maybe inundating them with calls might help us reach Mr. Charles Oppenheim office and get some explaination about the visa allocation process.
I tried calling, but today is a Federal Holiday. Will try again tomorrow.

I dont think you need to worry.. for you knwo what I am saying ...:D
May be I need to give a reason. I didn't worked for the whole year because there were no jobs. I just stayed at home depressed.
Not working and there by not getting salary signifies out of status? I am not sure about that. I didn't traveled outside of the country couple of times after that.

In December, the CIS Ombudsman's Office began a pilot teleconference program on issues of concern to individuals and employers as they interface with USCIS. We have had three such pilot teleconferences so far and in February will continue with a few more. Please join us on Friday, February 16, from 11:00 a.m.-12:00 noon EST for the "Newark District Office: How Is It Working For You?" We look forward to hearing your comments, thoughts, and suggestions for improvement as well as any best practices you have noticed in your interaction with that office. We also would appreciate your thoughts regarding the Cherry Hill , NJ field office.
To participate in Friday's call, please RSVP to cisombudsman.publicaffairs@dhs.gov. The first 50 people to sign up will be able to participate and will receive a return email with the call-in information. If you are unable to participate on Friday, stay tuned for similar upcoming programs which will be posted on our website, www.dhs.gov/cisombudsman. Also, if you have a topic of interest for a future call, please send it to cisombudsman.publicaffairs@dhs.gov.
We appreciate your assistance with this pilot program.

Time and again I am telling. EB 3 problem is due to 245(i) cases. Once 245(i) primaries are over, their dependent will come into the picture, who are waiting back home. All 245(i) cases have PD before April 2001. For time being, EB3 I or Mexico move beyond April 01 but again retrogress back to the April 01 when cases are accumulate at CP. This is the reason why EB3 I and Mexico is not moving since last many years.
If some one is not convince with me, request under FOIA
1. How many cases filed under 245(i) in India, Mexico, and ROW
2. How many cases filed under I 824 Follow to Join since 2007?
I agree with your observations except the point that it will retrogress again to 2001.
As dates have moved beyond April 2001, I don't believe there will be any more 245(i) s coming into the queue. Dependents of 245(i) applicants would have a PD of Apr 2001 or before. They already got their GCs by now. 245(i) applicants would have filed for their dependents already. If these 245(i) applicants file for relatives, they WON'T have 2001 PD.
Please correct me if I am wrong.

This part is self-explanatory. It seems that USCIS made a list of all the applicants to Jul 08, 2007 by setting PD to Jun 01, 2006.
Documentarily Qualified might possibly imply:
.. Medically OK
.. FP and Name Check OK
.. Everything in application is consistent (e.g. DOB, Name, Kids, Spouse)
.. Requires No RFE
.. Requires no interview
.. Just requires GC (Visa) Number
My 2 cents input
Thanks for your response,
I did some more searching on the DQ issue... it seems like it is a term applicable only to consular processing. When a visa applicant has responded to something like an RFE by sending a form DS2001 AND has cleared all background checks - he/she is called "DQ".
The equivalent for AOS cases may therefore be
- Completed and signed I-485 + Fees
- All initial evidence sent such as medical etc.
- Background checks cleared (or 180 days have passed)
My guess is DQ does not mean pre-adjudicated (I hope so...)

You don't have to struggle in home country. You were born and raised there and I do not see a need to struggle.
And you are not struggling here also, you have come to pursue your dream, everyone here have jobs, we are just trying to fix a broken system here.
I have 2 European co-workers. They both told me, "The only way we will go back to Europe is when we die".

after going through Logiclife's posts, I remembered all the horror stories I see happening aroung me since past 6 years, I also had arole in one of them.
Just thought a low-budget film about 'H-Horror' will be a good idea to expose these desi companies.

btw law states that domestic violence is a deportable offence. it is taken seriously by uscis. even convicted greencard holders are deported.

I'm having less and less faith in the claims made by members that USCIS is inefficient and clueless. ok, they have been and continue to be in many areas:):). However, they have a game plan this time. In retrospect, we know they had a game plan in June 07 also.
There are several unknown variables (repeatedly and extensively discussed here)which make accurate prediction impossible for us. However, USCIS has the numbers of RIPE CASES. And they moved the dates based on the availability of remaining GC numbers for this fiscal AND the ripe cases.
They could have moved it to just Dec 2005, instead they moved it all the way to June 2006.
Best\ optimistic scenario- Most EB-2-I cases upto June 2006 will be adjudicated before Oct 1st.
Conservative scenario-Upto at least Dec 2005 PD all cases will be adjudicated , and a few CP cases into early 2006 will be adjudicated. With spillovers happening in each quarter, the PD should continue to move.
Hello Gurus,
I have red in many places that there is some cases which are "Low hanging fruits" or "Ripe cases" when they say this what exactly this means? my understand is that for USCIS every case which has all proper supporting documents then they will adjudicate that case no matter what if VISA number available, can some one help in understanding what is "Low hanging fruits" or "Ripe cases":confused:

Lawmakers will decide to bring up the issue and vote on the bill. Attend all Lawmaker meetings.
In this meeting, the staffer will give you his/her business card. Follow up with the staffer after the meeting, specially when the bill is coming up for vote.

It doesn't say that anywhere in the link. The 485 filing instructions clearly state what the initial evidence is.
There is no doubt the employer letter is required.
The only question is:
1) is it safer to wait for RN and then submit this letter as evidence quoting the A# assigned, OR
2) is it a better idea to submit a new I-485 rightaway along with the letter, OR
3) should such people just wait hoping they will receive an RFE (I don't like this one at all) whenever the case is opened?
