Like I said earlier I pretty much feel the same way as you do. I want my spouse to be able to work for a couple of years before I think of moving back to India. But in reality having waited so many years do you think either you or myself will move back 2 years after getting the GC? Don't you think you will be tempted to wait 3 more years get the US citizenship and then move back? I have a few friends who are pretty much just waiting to get citizenship to move back. their argument is that we waited several years to get a GC and we don't want to just throw it away.
As for making H1B more humane I think it will never happen.
Most H1B holders get very good offers when they move back to their home countris after say 10 years. But the H4 spouse who spent al these years rotting in the USA again have to continue rotting....Their prospects are dim. So I want to get my GC. Let my spouse work here for couple of years and move back to my Own country.

H1b and Green cards are allowed to have out of country stays. so if you are out of country for less than six months, it may still be considered as continuous stay. the intent of writing the word "continuous" is to declare that at any point, the immigrant had no intentions to leave the country and relinquish his immigrant status. for the legal immigrant, that should be acceptable.
Sec. 245B. (a) In General- The Secretary of Homeland Security may adjust the status of an alien to that of an alien lawfully admitted for permanent residence if the alien-

Am I wrong or is there very little interest in this bill from IV - or for that matter other immigration groups?
I understand that its going to be hard to get ANY legislation passed over the next couple of quarters, but I think getting behind these inital ones will lead to a growing momentum. This momentum is what will eventually lead to any immigration changes..

Per my attorney and several forums i researched a second FP Is generally sent when your case is about ready to be approved and normally a good sign as they can approve GC and ask for FP after that before sending you cards. However in one forum i found someone posted a DHS release from 2007 describing the FP data is switched to digital storage in a system called BSS and will remain valid for 75 years, thus one theory says that if your first FP was done digitally you may not need second FO and IO can access the results of first FP and approve. But who knows what is true, all of these are speculations.
I have not got second FP notice either and my first and only FP happened in Nov 2007.
I got a 2nd FP notice for 485. I will be current next month. I also applied for AP last month, which got approved yesterday. Not sure if AP application triggerred the FP notice or if there is a chance I can get approved next month??

Yes you are right. We need patience till you get your GC...I know its hard but there is no other way but swallow that pride. Its very hard to do that..speaking of which this anti-indian guy who sits next to me at work was making life horrible for few weeks. Things are sorted out now... I have a great Manager.
I really feel sorry for Neelima's family... wish I could have helped them.

I prayed god to get my GC before 2008.If God really exists I'll get my GC in 2008.If not it's a proof that God doesn't exists.
I'll have to wait for few more hours to prove.
How Simple is the Test ..for the existence of God...Why GC you can do some easy tests too like
Throw a glass Jar from 10th Floor of builing to the hard ground and if Glass JAR does not break then God exists other wise not
You can apply for job and don't appear for interview and if you still get a job then god exists otherwise not

I-140 online status may or may not change in such cases. Your case being in extended review is raising some flags. Do you know anything about the kind of extended review that was going on. Your lawyer on file, as well as you should get a copy of the notice. Make sure no communication was sent to the lawyer from Company A. Sometimes USCIS does not update the lawyer information even though a new G-28 is submitted. You will have to just wait for the denial notice. Send an email to info at immigrationvoice dot com so IV can get in touch with you to help.

Other thing to be Indian or representing Indian traditions is not a crime but certainly every time barking against anything Indian may certainly be a crime as it is a clear indication of closed door or prejudicial mind towards one particular country and culture. I have to agree with you on this. Its not like Bollywood did not make movies before Danny Boyle made one about slums and poverty in India. There were so many good movies made by Indians with not a single white or foreign contribution, but never even released outside of India. It took a white man to come and show the world the poverty stricken children of India that the world stood up and took notice.
My hope is that things will change now. Just as the world has realized the technical talent Indians have in IT and Business, my hope is that they realize that we have others talents too!
All said, congratulations to ARR and Pooktty. I hope Danny Boyle really keeps up his word to those kids to help in thier education.

All I can say is that everyone has their personal reasons for the decisions they make. This thread is information exchange thread for those who are looking to move to Canada. This isn't about why one should go one place vs another.
I welcome you to start another thread where ppl can debate whether they should move to India or consider moving elsewhere. In fact, I will be happy to discuss the options there. But I request ppl to not divert the focus of this thread.
Why don't you start a similar forum for "going back to India" ? I hate to burst your "bubble of hope" but Canadian population and job market is limited and the opportunities for professionals like us are limited. Why not consider going back to India and taking up some of the lucrative opportunities in middle management in the IT industry.
The Indian economy is booming and the salaries are excellent. You just need to make some adjustments with quality of life (pollution, traffic). Atleast its better than going to Canada, living in limbo while looking for suitable jobs for a long-time, sometimes even doing odd jobs just to make ends meet. I hate our Indian mentality that "every place in the world is better than our own country". Give me a break guys.
My plan of action is very clear: Go back to India and live there happily. If there are other opportunities in US then come back.

Hi All,
I filed my I485 in 08/05 and my labor date is 07/05 in perm. My I140 got approved in 2007.
I was in bench for around 6 months in 2008 starting from Jan 1st to 06/20th. I took full time position in last week of 06/08 and continuing in the same job. I got RFE on my I485 and asked for employment verification in 12/09. My attorney replied with presnt employment letter and applied for AC21 also at the same time. Now i got another RFE asking for last 5 years employment letter, w-2 forms and tax returns.
Can some one please let me know how i can handle the period that i was in bench in 2008.

Following is my take on this (I am not a lawyer):
- I dont think you need to have "continuous employment". (I am assuming that you were not any employement visa (H1) during the "bench period"
- You already have EVL letter that states that "a permanent job -same or similar- is ready for you once you get your GC"--that is your AC21
- Your 485 was filed way before "bench period".
- During the bench period if you were only with "pending 485 authorized period of stay" (ie. not on H visa), you were not "required" to maintain employment any way. (If you were on any employment visa, you are out of status during that period).
So my advise: Just submit all the documents related to your employment history. Do not lie or falsify any information. You will be just fine.
Again, this is just my opinion. Follow the lawyer's advise.

I have heard someone say that I might escape the new law if I get a Green Card before the law is enenforced on (10/1/2008). Does this assumption even hold any ground? Doesn't the proposed bill say that anyone who has filed I-140 after May 21st 2007 has to reapply regardless of where he is in the process.

1. Are all applications which have a 485 RD within the processing date, are processed? or
2. Only applications which have a RD within the processing date and whose PD is current, are processed.
As per the uscis approvals it was all happening randomly,,sometimes they stick with rules and sometimes not..ofcourse PD should be current but ProcessingDates vs 485 RD its still stands a mystery.
