* We reported yesterday that foreign professionals have been sending flowers to the heads of involved agencies with a message of protest for the ongoing visa bulletin fiasco. Sorry to hear about such cases. We all have to realize one thing here. The employers need us equally bad as we need them (more often than not, not talking about Indian consultancies here). If ever one encounters such racial discrimination and open abuse at the work place, the best recourse is to file a complaint with the higher ups in the HR, start searching for another employer and ditch the current racist employer at the right moment with an appropriate email sent to everyone detailing why the person is leaving at such an important phase of the product development. Yeah, this might sound un-ethical, but sometimes situations do demand such drastic measures to send the right message. That's when all these racist employers would realize the importance of the person that just left the company. Then they can try to fill in the position with their preferred race qualified person and see how difficult that gets!!
Better still, please talk to your friends and family in other parts of the US and find the areas in the US that are cosmopolitan and try to move to those places. Yeah that is very difficult in the short-term, but in the long-run, you would have peace of mind and a good quality of life after making such a move. Fortunately, i am in the Bay area and i have rarely encountered such racial prejudices out here. Just my two cents.

I thought of leaving this company several times, but I am working in this company for 6 years and the only company I worked after coming to USA. I invested so much for this company, like working beyond work hours, working in the weekends, making up the project deadlines for the incompetitive colleagues etc. etc. and now just waiting for my Green Card. There were so many times I thought if I get my Green Card I am going to leave this moment. Years passing by and with this retrogression thing, there is very little hope of getting it soon...
The positive thing is, my direct supervisor is very nice and I can voice my opinion and she understands me and completely supports me. I am just praying god that I should keep working for her till I get the GC.

I was at USCIS this morning, followed every thing you suggested. My IO officer was actually a desi guy.
1) They completely refused to look at the received date, I had my EAD (765) receipt, but the IO said he only cares about the receipt date. I even has the print out from USCIS.gov in which they have mentioned that they will honor the date on which applications were received in the mail room but he did not budge. His argument was " That update is in the over all scheme of things, but for EAD they have specific instruction to follow only the date they entered the data in the system"
2) I was not allowed to see a supervisor, the IO did talk to the supervisor but did not let me see her.
So they refused to acknowledge that it is pending more than 90 days?
They are technically right, the regulations say "within 90 days from the date of receipt of the application".
Talk about broken promises. Write to the USCIS ombudsman.

Thanks for the reply , let me file the H1 transfer with Employer2 now in "Premium route" with the I-140 approval from Employer1 and see if we get a approval. Once i get a approval , i think stamping it wont be an issue after 7-8 months even thought Employer1 has revoked that I-140 ?
However i want to clear even if the Employer1 revokes this I-140 my PD still remains locked - right ???

No, I-140 must be active in order to extend H1-B beyond 6 years.

It was a great meeting. I was blown over by the enthusiasm of the folks. It was intended to be a casual get together, but beyond a point it became more serious:D We did have action items and we will communicate it through emails, we cannot post such things on public forum. We are working on the next event planning once we finalize the place and time we will get in touch with U.
can you hold these meetings on saturdays? weekdays are impossible for me with a 1.5 hr commute (common with most tri-state folks).

Sorry to hear this. Regarding medical insurance, your company has to offer you COBRA..you will end up paying almost twice the premium that you have been paying so far, but it would still be better than you footing the delivery charges (10k - 25K). Continue CORBA atleast till the deliver and post-partum - for as long as possible..
Terminating you in your ninth month pregnancy is probably against the law, i think if you can prove it, you might be able to sue your employer, check your local state laws..

After you wait for 7-8 years in your category for your visa your thougths will change. I have MS from an american university + work experience. Our lawyer decided to file EB3 in 2001, they convinced the company that EB3 is easier to get approved. i am still waiting for my GC, in the mean time i have gained a lot of experience, i am still an EB3 for USCIS. There are many in a similar position.
People talk about unethical practices etc. i feel that they ones who jumped the queue and used agressive lawyer already have their green cards. Most of my friends are already thinking about citizenship (and ROI after USC..that is a different forum :)).
Its people working in multinational companies who follow the law by the book are the ones who get screwed, its just my observation and opinion ..good or bad, i dont know...
