(1) To carry out programs that provide education and training to establish nursing career ladders to educate incumbent healthcare workers to become nurses (including Certified Nurse Assistants, Licensed Practical Nurses, Licensed Vocational Nurses, and Registered Nurses). Such programs shall include one or more of the following:
(A) Preparing incumbent workers to return to the classroom through English as a second language education, GED education, precollege counseling, college preparation classes, and support with entry level college classes that are a prerequisite to nursing.
(B) Providing tuition assistance with preference for dedicated cohort classes in community colleges, universities, accredited schools of nursing with supportive services including tutoring and counseling.
(C) Providing assistance in preparing for and meeting all nursing licensure tests and requirements.
(D) Carrying out orientation and mentorship programs that assist newly graduated nurses in adjusting to working at the bedside to ensure their retention post graduation, and ongoing programs to support nurse retention.
(E) Providing stipends for release time and continued healthcare coverage to enable incumbent healthcare workers to participate in these programs.
(2) To carry out programs that assist nurses in obtaining advanced degrees and completing specialty training or certification programs and to establish incentives for nurses to assume nurse faculty positions on a part-time or full-time basis. Such programs shall include one or more of the following:
(A) Increasing the pool of nurses with advanced degrees who are interested in teaching by funding programs that enable incumbent nurses to return to school.
(B) Establishing incentives for advanced degree bedside nurses who wish to teach in nursing programs so they can obtain a leave from their bedside position to assume a full- or part-time position as adjunct or full time faculty without the loss of salary or benefits.
(C) Collaboration with accredited schools of nursing which may include community colleges and other academic institutions providing associate, bachelor’s, or advanced nursing degree programs, or specialty training or certification programs, for nurses to carry out innovative nursing programs which meet the needs of bedside nursing and healthcare providers.
(h) Preference- In awarding grants under this section the Secretary shall give preference to programs that--
(1) provide for improving nurse retention;
(2) provide for improving the diversity of the new nurse graduates to reflect changes in the demographics of the patient population;
(3) provide for improving the quality of nursing education to improve patient care and safety;
(4) have demonstrated success in upgrading incumbent healthcare workers to become nurses or which have established effective programs or pilots to increase nurse faculty; or
(5) are modeled after or affiliated with such programs described in paragraph (4).
(i) Evaluation-
(1) PROGRAM EVALUATIONS- An entity that receives a grant under this section shall annually evaluate, and submit to the Secretary a report on, the activities carried out under the grant and the outcomes of such activities. Such outcomes may include--
(A) an increased number of incumbent workers entering an accredited school of nursing and in the pipeline for nursing programs;
(B) an increasing number of graduating nurses and improved nurse graduation and licensure rates;
(C) improved nurse retention;
(D) an increase in the number of staff nurses at the healthcare facility involved;
(E) an increase in the number of nurses with advanced degrees in nursing;
(F) an increase in the number of nurse faculty;
(G) improved measures of patient quality as determined by the Secretary; and
(H) an increase in the diversity of new nurse graduates relative to the patient population.
(2) GENERAL REPORT- Not later than September 30, 2013, the Secretary of Labor shall, using data and information from the reports received under paragraph (1), submit to Congress a report concerning the overall effectiveness of the grant program carried out under this section.
(j) Authorization of Appropriations- There are authorized to be appropriated to carry out this section for fiscal years 2012, 2013, and 2014, such sums as may be necessary. Funds appropriated under this subsection shall remain available until expended without fiscal year limitation.
SEC. 4. COLLECTION OF DATA AND REPORTS TO CONGRESS ON FOREIGN-TRAINED NURSES NEWLY ADMITTED TO THE UNITED STATES EACH FISCAL YEAR.
(a) Requirement To Collect Data- With respect to each fiscal year, beginning with fiscal year 2011, the Secretary of Homeland Security shall collect the following data for each alien that acquires the status of a lawful permanent resident or a temporary alien worker (including as a temporary professional worker under the North American Free Trade Agreement) during that fiscal year for employment as a professional nurse:
(1) The country of residence and country of nationality of the alien at the time such status is acquired.
(2) The country or countries in which the alien received the professional education and training to be licensed as a nurse.
(3) The name and address of the petitioning employer.
(4) The name and and address of any recruiting agency used by the petitioning employer with respect to the recruitment, processing or preparation of the alien for the employment involved.
(5) The processing time for review and action on the petition with respect to each such aliens.
(b) Research of Data From Prior Fiscal Years-
(1) With respect to the fiscal years 2006 through 2010, the Secretary shall determine which of the data required to be collected pursuant to subsection (a) are available for retrieval in electronic databases maintained by the Secretary.
(2) In preparing the report for fiscal year 2011 mandated by this section, the Secretary shall include a summary of all such available data for fiscal years 2006 through 2010.
(c) Reports- The Secretary shall submit annual reports aggregating the data collected under subsection (a), and, with respect to the report for fiscal year 2011, such additional data identified pursuant to subsection (b), along with such related information as the Secretary determines to be appropriate, to the Committees on the Judiciary of the House of Representatives and the Senate not later than 90 days after the end of each fiscal year. Such reports shall include--
(1) the aggregate number of aliens who acquired a status described in subsection (a) during such fiscal year and subtotals of the status categories acquired;
(2) subtotals within each status category for the data element collected pursuant to subsection (a); and
(3) the average processing times for each different type of petition or application involved in the acquisition of status.
(d) Publication in the Federal Register- The Secretary shall cause to have published in the Federal Register notice of the submittal to the Committees on the Judiciary of the House of Representatives and the Senate of each report required under subsection (c) and of the availability to the public of each such report.

I have a different situation.
My EAD was sent back to USCIS beacuse they forgot to include apt#.
I called USCIS and they rectified the error told me that they will resend it again.
I have got the I765 receipt but not EAD card.
I called them again, they sent me letter saying that they will consider this case as lost in mail beacuse they did not get the returned EAD from poast office.
USCIS sent me a letter asking me to apply again.
DO I need to pay fee for that? It was mistake from USCIS side they have address wrong!
Does any body know what to do?

I alos filed EAD renewal and Receipt came very fast. within 7 days. However when I enter case# on USCIS website, It says Case not Found

On the uscis case staus site one has to type the receipt number which is either a SRC or LIN number. Make sure u dont type the hypens.
If u are typing correctly then just wait for a few days. Dont worry.
Last year we did see that there was a huge delay between actual check cashing, actual physical reciept in hand and the USCIS site was not updated at all. Happens a lot of times. Give yourself about 1-2 weeks and call USCIS.

The fact that the law permits some things, does not have any bearing on the moral severity or the lack thereof, of those things. Would you choose a 'prostitute' over a 'shop lifter' for a wife? If these are the only 2 options, I would be content with a shop lifter. Would you choose a 'prostitute' because there are no criminal issues involved and you will get your greencard faster?

That is life...if you factor in the inflation rate to your 20.8 lakhs...you will realise that it would have been better if you had at least 'enjoyed' your stay here instead of trying to increase the national savings rate.
Maybe now spending that $20 on IV might not sound that bad...after all, these days, its not much in rupees too...2wadas and one chai, thats about it, my friends :mad:

I am watching visa bulletin for 1 years now and found that if it releases early around 8th to 10th of month then no good movement but if releases close to 15th .. like 13th or 14th then some very good movement.

You should rather analyze how many people from India made innovations like starting a company, a technology, patenting a process etc, on H1B versus on GC?.
Innovation starts when slavery ends. Free thinking and ideas arise often even on H1B, but people can easily act on them when not having to worry about getting kicked out of the country. For your information there are a LOT of companies (and patents) started by Indians who have made it big here. Most of them came on H1B. Similarly there are a lot of companies in the tech area that are starting up in India.
Again best and brightest does not mean innovation and patents alone. It can also refer to the ability to solve existing problems, design processes that need not be patentable.

I found this interesting comment from a blog. It has been posted by an H.R. representative who has access to H1B and GC users' records. The points raised are indeed valid and they seem to have a 'case' against us. I do not by any means want to undermine our efforts but it does provide a perspective from the 'citizens' perspective.
The bill would also drastically increase the number of H-1B visas issued to foreign professional workers. As a Human Resources representative, I see first hand how the H-1B visa and employment based green card programs actually work together to drive U.S. white collar workers from their jobs and even from their careers. To begin with, there is virtually nothing in the law that prevents employers from hiring H-1Bers for open positions even if qualified Americans are available and willing to do the work. Americans are routinely laid off and replaced with lower paid H-1Bers also. In these cases, Americans have practically no legal recourse available under current law. H-1B is also a dual intent visa, so an employer may sponsor an H-1Ber for an EB green card for legal permanent resident status. When a company seeks to sponsor a foreign worker for an EB green card, they are required by law to demonstrate a good faith effort to recruit Americans first. This process is called labor certification. But employers routinely game the labor certification process for green card sponsorship to defraud even well qualified citizen job applicants in favor of low wage foreigners. They use fake job ads and/or bad faith interviews of American citizens to convince the federal government that they tried to find American workers first. These practices are common in high tech and even in some non-tech industries, but HR people are told to keep quiet about it or lose their jobs.
I would be in favor of a program that issues a small number of self-sponsoring green cards for truly innovative foreign nationals on a competitive basis. But very few of the H-1Bers or green card applicants that I have seen in 10+ years even come close to being truly innovative. Most are just practitioners with skills that are actually quite common among the domestic workforce. The only thing special about these foreigners is that they will work for substantially less than Americans in order to have a chance to become legal permanent residents. Thus they are used by management to sweeten corporate balance sheets.
The prevailing wage regulations are supposed to insure that foreign nationals are paid the same as their American counterparts in the same job functions, but these regulations are so riddled with loopholes that they are a bad joke.
Since my work allows me to have access to salary records, I can tell you that the labor cost savings for H-1Bers and green card applicants is substantially greater than the costs of filing the applications with the government.
Citizens should demand that both the H-1B and employment based green card programs be abolished in their current form.
My point is if we check our credentials, how many of us are 'true' innovators? I know I am not, I am an expert in what I do and am an asset to my company but I haven't filed any patents or publications which would be the true requirement for this country. My skills are indeed readily available in domestic workers as well. Could that be the reason for the backlog in EB-3 and none in EB-1? So do we need to do a reality check here? Innovation starts when slavery ends. Free thinking and ideas arise often even on H1B, but people can easily act on them when not having to worry about getting kicked out of the country. For your information there are a LOT of companies (and patents) started by Indians who have made it big here. Most of them came on H1B. Similarly there are a lot of companies in the tech area that are starting up in India.
Again best and brightest does not mean innovation and patents alone. It can also refer to the ability to solve existing problems, design processes that need not be patentable.

I found this interesting comment from a blog. It has been posted by an H.R. representative who has access to H1B and GC users' records. The points raised are indeed valid and they seem to have a 'case' against us. I do not by any means want to undermine our efforts but it does provide a perspective from the 'citizens' perspective.
The bill would also drastically increase the number of H-1B visas issued to foreign professional workers. As a Human Resources representative, I see first hand how the H-1B visa and employment based green card programs actually work together to drive U.S. white collar workers from their jobs and even from their careers. To begin with, there is virtually nothing in the law that prevents employers from hiring H-1Bers for open positions even if qualified Americans are available and willing to do the work. Americans are routinely laid off and replaced with lower paid H-1Bers also. In these cases, Americans have practically no legal recourse available under current law. H-1B is also a dual intent visa, so an employer may sponsor an H-1Ber for an EB green card for legal permanent resident status. When a company seeks to sponsor a foreign worker for an EB green card, they are required by law to demonstrate a good faith effort to recruit Americans first. This process is called labor certification. But employers routinely game the labor certification process for green card sponsorship to defraud even well qualified citizen job applicants in favor of low wage foreigners. They use fake job ads and/or bad faith interviews of American citizens to convince the federal government that they tried to find American workers first. These practices are common in high tech and even in some non-tech industries, but HR people are told to keep quiet about it or lose their jobs.
I would be in favor of a program that issues a small number of self-sponsoring green cards for truly innovative foreign nationals on a competitive basis. But very few of the H-1Bers or green card applicants that I have seen in 10+ years even come close to being truly innovative. Most are just practitioners with skills that are actually quite common among the domestic workforce. The only thing special about these foreigners is that they will work for substantially less than Americans in order to have a chance to become legal permanent residents. Thus they are used by management to sweeten corporate balance sheets.
The prevailing wage regulations are supposed to insure that foreign nationals are paid the same as their American counterparts in the same job functions, but these regulations are so riddled with loopholes that they are a bad joke.
Since my work allows me to have access to salary records, I can tell you that the labor cost savings for H-1Bers and green card applicants is substantially greater than the costs of filing the applications with the government.
Citizens should demand that both the H-1B and employment based green card programs be abolished in their current form.
My point is if we check our credentials, how many of us are 'true' innovators? I know I am not, I am an expert in what I do and am an asset to my company but I haven't filed any patents or publications which would be the true requirement for this country. My skills are indeed readily available in domestic workers as well. Could that be the reason for the backlog in EB-3 and none in EB-1? So do we need to do a reality check here? Is there any way to know whether our case is already preadjudicated or not? Is it OK to call USCIS customer service number or taking an infopass appointment for just checking that?
I just want to have some peace of mind as USCIS is not require (hopefully :)) any documents from our side, if they already preadjudicated us.

I called service center..those who have applied to TSC ,they kept all the applications on hold which came on 2 nd July and started to put them into their systems from July 20th ,so just hope to see your check getting cashed by this or next wk...

Applied for EAD extension on July 08-2008 (expiring on Sep 30-08), less than 90 days. Got a 2 year extension in Mail Aug-14-2008 (Approval date Aug 07-2008).

This is not the accepted procedure, and if the person left without having AP or without having H1B, H-4, L-1 or L-2 status, s/he is deemed to have abandoned the I-485 Adjustment of Status application.

Dear snehaledu, You raise a good point. Am I IV policeman? The answer is NO. Guess, it is the responsibility of all the members to police themselves. And I saw that it was not happening here, thus my question about the relevance of this thread.
I understood that IV is working on behalf of green card backlog applicants and the intended purpose of IV forums is to provide support for legislative effort. Please help me understand how this thread about $1 is Rs. 44 or whether $1 is Rs. 46, helping in achieving IV goals? I am just scratching my head in an attempt to figure that out. There are many other forums on the internet where you could discuss anything under the sun. There are many other forums where you could discuss everything about exchange rate variations. Why don�t you go and discuss it over in those forums?
Also, we all should be considerate towards all other members of IV. It was my understanding that IV membership includes people from all over the world. It may be true that majority of IV members are from India. Should we as Indians show a bit of maturity and consideration towards members from other countries? Is that too much to ask? Say, if you come to these forums and for 2-3 days consecutively you see a discussion about conversion rate of Pakistani Rs. to $, how would you feel about it as that discussion will not be relevant for you? I guess there is no country in the world where its entire population is either all fools or all intelligent. The real question is which category do you belong? You don�t have to answer that question; your behavior will speak for you.

There is great opportunity for collaboration between IV and USINPAC. USINPAC stands to gain future members from those of us who graduate to a GC. IVs mailing list would be an extremely valuable tool in this regard.
As IV members graduate to a GC, they have to evaulate what political causes they want to support. The absence of a viable PAC supporting the cause of skilled legal immigration is also an opportunity for the future evolution of IV, where establishing a PAC supported by contributions from IV graduates will reinforce IVs message.
