[QUOTE=girishvar]I know Robinder Personally for a long time. He is Championing the cause of Ind0-US affairs with his headquarters in India. He is also the very senior columnist and well respected media person in Delhi. Being a Bachelor and previous personal assistant of Rajiv Gandhi, when he was a PM, he has never entered politics and very honest altruistic man. Calling him a fraud should be incorrect.

I smell that you are a paid poster of USINPAC. I am asking the adminstrator of the IV site to track your I.P address to see if this post is coming from some one at USINPAC.

I think IV would like to work with USINPAC provided that they truely believe in the cause of immigration reform. Seeing the P.R that comes out of them and the content of their site, they seem to be good at issuing PR's like USINPAC applauds xz, USINPAC supports xyz,USINPAC Photo gallery etc.. I mean grand standing from the side lines and then taking credit for (as some one mentioned here,) for the sun rising tomorrow morning. Don't take it personally but the content on their site is cheesy and points to cheap publicity. I am told that much of the lawmaker community and the media has come to realize this image of USINPAC in DC.

I do sincerely hope that they find direction regarding what issues they want to work for and where they want to take their organization. All the best.

    I have a different situation.
My EAD was sent back to USCIS beacuse they forgot to include apt#.
I called USCIS and they rectified the error told me that they will resend it again.
I have got the I765 receipt but not EAD card.
I called them again, they sent me letter saying that they will consider this case as lost in mail beacuse they did not get the returned EAD from poast office.
USCIS sent me a letter asking me to apply again.

DO I need to pay fee for that? It was mistake from USCIS side they have address wrong!

Does any body know what to do?

I alos filed EAD renewal and Receipt came very fast. within 7 days. However when I enter case# on USCIS website, It says Case not Found
Do I need to worry about it ? Or Need to wait for couple of weeks?
    Please advice.
    Thanks

I am sure u must be typing correct.But.
On the uscis case staus site one has to type the receipt number which is either a SRC or LIN number. Make sure u dont type the hypens.
If u are typing correctly then just wait for a few days. Dont worry.
Last year we did see that there was a huge delay between actual check cashing, actual physical reciept in hand and the USCIS site was not updated at all. Happens a lot of times. Give yourself about 1-2 weeks and call USCIS.

And you are defending a guy who has committed shop-lifting with this? You should have probably come out with more ammunition than this. Because of ppl like the OP and maybe you, we Indians are getting a really bad rep everywhere. I am sick and tired of defending our community, when ppl like you and the OP defend (or even condone, in the name of an immigration query) such acts with no compunction. Shame on the OP and for defending him, YOU!

OP, please get lost from this forum and from this country. This country is not for criminals like you (there are enough already). I wish you had gotten a stricter sentence than what you got. And those of you that want to defend the OP or the folks that condone such acts, in the name of immigration, dont need to lecture me on taking this stance - just get lost, will ya!

I wish the Admins delete this thread and not encourage such postings!

Did my post suggest in any way that I was defending the guy? I was only ridiculing those who were bad mouthing him.

Are you suggesting that my post would have scored more points if I came out with more ammunition? I did not post in order to win your accolades. The fact that you felt there is not enough ammunition, suggests to me that you think it is perfectly fine to do all those filthy things I was referring to. This tells me about your moral standard.

You had to assume that I probably have a criminal issue too, and thats why I was defending the original poster? Is that the best your mind can think of?

You are sick and tired of defending our community? Do you imply that most people from our community have turned to criminal acts these days, and so you are tired? Because, I have not seen that around the people that I move around with. Is it all too common in your circles and the people you associate with?

You most probably have half the education that I have, your salary is most likely half that of mine, and your moral standard is probably half that of mine. If I start ridiculing you more, you will suffer sleepless nights. So I won't do it (after this post, I mean).

You don't post bullshit in a public forum, just because you can't see the people you are talking to, infront of you. Would you dare call the original poster 'thief' if he is standing infront of you? Would you call him that, if he is a friend of your roommate and your roommate brings him over to your house? The internet must be a new technology for you. Please learn how to use it to spread some love.

    To the poster above you:
It is true that the law does not impose punishments on backstabbers, womanizers, sexual perverts, etc. Prostitution is legal in a lot of countries. The fact that the law permits some things, does not have any bearing on the moral severity or the lack thereof, of those things. Would you choose a 'prostitute' over a 'shop lifter' for a wife? If these are the only 2 options, I would be content with a shop lifter. Would you choose a 'prostitute' because there are no criminal issues involved and you will get your greencard faster?

Even though not many people have posted in support of my post, my reputation has gone up, and yours probably went down. Please don't respond just because you want a revenge.

I will always stand up for the one weak guy who is bullied by a 100 really nice & powerful ones. This can't be called defending the act of 'shop lifting' !!!

(non indians please ignore this part - due apologies)

    - desis who spent the formative years of their life here doing -- desigiri-- saved some money to go back, only to find that the money saved is not worth that much anymore.;)

That is life...if you factor in the inflation rate to your 20.8 lakhs...you will realise that it would have been better if you had at least 'enjoyed' your stay here instead of trying to increase the national savings rate.

Maybe now spending that $20 on IV might not sound that bad...after all, these days, its not much in rupees too...2wadas and one chai, thats about it, my friends

You should rather analyze how many people from India made innovations like starting a company, a technology, patenting a process etc, on H1B versus on GC?.

Innovation starts when slavery ends. Free thinking and ideas arise often even on H1B, but people can easily act on them when not having to worry about getting kicked out of the country. For your information there are a LOT of companies (and patents) started by Indians who have made it big here. Most of them came on H1B. Similarly there are a lot of companies in the tech area that are starting up in India.

Again best and brightest does not mean innovation and patents alone. It can also refer to the ability to solve existing problems, design processes that need not be patentable.

    Hi,
I found this interesting comment from a blog. It has been posted by an H.R. representative who has access to H1B and GC users' records. The points raised are indeed valid and they seem to have a 'case' against us. I do not by any means want to undermine our efforts but it does provide a perspective from the 'citizens' perspective.

The bill would also drastically increase the number of H-1B visas issued to foreign professional workers. As a Human Resources representative, I see first hand how the H-1B visa and employment based green card programs actually work together to drive U.S. white collar workers from their jobs and even from their careers. To begin with, there is virtually nothing in the law that prevents employers from hiring H-1Bers for open positions even if qualified Americans are available and willing to do the work. Americans are routinely laid off and replaced with lower paid H-1Bers also. In these cases, Americans have practically no legal recourse available under current law. H-1B is also a dual intent visa, so an employer may sponsor an H-1Ber for an EB green card for legal permanent resident status. When a company seeks to sponsor a foreign worker for an EB green card, they are required by law to demonstrate a good faith effort to recruit Americans first. This process is called labor certification. But employers routinely game the labor certification process for green card sponsorship to defraud even well qualified citizen job applicants in favor of low wage foreigners. They use fake job ads and/or bad faith interviews of American citizens to convince the federal government that they tried to find American workers first. These practices are common in high tech and even in some non-tech industries, but HR people are told to keep quiet about it or lose their jobs.

I would be in favor of a program that issues a small number of self-sponsoring green cards for truly innovative foreign nationals on a competitive basis. But very few of the H-1Bers or green card applicants that I have seen in 10+ years even come close to being truly innovative. Most are just practitioners with skills that are actually quite common among the domestic workforce. The only thing special about these foreigners is that they will work for substantially less than Americans in order to have a chance to become legal permanent residents. Thus they are used by management to sweeten corporate balance sheets.

The prevailing wage regulations are supposed to insure that foreign nationals are paid the same as their American counterparts in the same job functions, but these regulations are so riddled with loopholes that they are a bad joke.

Since my work allows me to have access to salary records, I can tell you that the labor cost savings for H-1Bers and green card applicants is substantially greater than the costs of filing the applications with the government.

Citizens should demand that both the H-1B and employment based green card programs be abolished in their current form.

My point is if we check our credentials, how many of us are 'true' innovators? I know I am not, I am an expert in what I do and am an asset to my company but I haven't filed any patents or publications which would be the true requirement for this country. My skills are indeed readily available in domestic workers as well. Could that be the reason for the backlog in EB-3 and none in EB-1? So do we need to do a reality check here? Just wondering if this could be the reason why we're getting a raw deal. Could it be that 'highly skilled' is not enough but 'genius' and 'highly skilled' is what's required here? Just a thought.

Is there any way to know whether our case is already preadjudicated or not? Is it OK to call USCIS customer service number or taking an infopass appointment for just checking that?

I just want to have some peace of mind as USCIS is not require (hopefully :)) any documents from our side, if they already preadjudicated us.

please advise us , accordingly we will make travel plans

    1. ..If we can mail the her New Advance Parole document to India.
    2. Can she Leave the country while her AP in Process

You cannot mail AP to her to use it for reentry to US. Find many of your answers here
    http://murthy.com/news/n_aostrv.html

Question 4. Should I wait for the approval of my application for AP before I travel?
    MurthyDotCom
Under current regulations, an AP document cannot be granted to a person outside of the U.S. One hears about people who did not wait for the Advance Parole document to be issued and had someone send it to them while they were outside of the United States. This is not the accepted procedure, and if the person left without having AP or without having H1B, H-4, L-1 or L-2 status, s/he is deemed to have abandoned the I-485 Adjustment of Status application.
    MurthyDotCom
While there may be some people who were allowed reentry into the U.S., either in error or on humanitarian grounds, it is risky to depart before the AP is issued. There are provisions for situations in which a person has the AP and requests an extension prior to departure, then does not rely on the AP extension to reenter the U.S., but uses it for a future trip abroad. This situation is different from leaving without having AP at all.

r u IV Policeman? Can I see your badge?

Dear snehaledu, You raise a good point. Am I IV policeman? The answer is NO. Guess, it is the responsibility of all the members to police themselves. And I saw that it was not happening here, thus my question about the relevance of this thread.

I understood that IV is working on behalf of green card backlog applicants and the intended purpose of IV forums is to provide support for legislative effort. Please help me understand how this thread about $1 is Rs. 44 or whether $1 is Rs. 46, helping in achieving IV goals? I am just scratching my head in an attempt to figure that out. There are many other forums on the internet where you could discuss anything under the sun. There are many other forums where you could discuss everything about exchange rate variations. Why dont you go and discuss it over in those forums?

Also, we all should be considerate towards all other members of IV. It was my understanding that IV membership includes people from all over the world. It may be true that majority of IV members are from India. Should we as Indians show a bit of maturity and consideration towards members from other countries? Is that too much to ask? Say, if you come to these forums and for 2-3 days consecutively you see a discussion about conversion rate of Pakistani Rs. to $, how would you feel about it as that discussion will not be relevant for you? Intelligent people understand the signs and fools dont understand even if someone shouts in front of them. I guess there is no country in the world where its entire population is either all fools or all intelligent. The real question is which category do you belong? You dont have to answer that question; your behavior will speak for you.

There is great opportunity for collaboration between IV and USINPAC. USINPAC stands to gain future members from those of us who graduate to a GC. IVs mailing list would be an extremely valuable tool in this regard.

As IV members graduate to a GC, they have to evaulate what political causes they want to support. The absence of a viable PAC supporting the cause of skilled legal immigration is also an opportunity for the future evolution of IV, where establishing a PAC supported by contributions from IV graduates will reinforce IVs message.
