    Thanks to every person who answered this post. I managed to get an appointment in mumbai for Aug 2nd. This will give enough time to send necessary document from my end and also give enough breathing to file the application.

    It is not true that Many people have to wait 10+ years to get gc. May be some people might wait for 10 years because of frequent change of jobs , layoffs and also ignorance of green card processing. Most of the time EB2 waiting time is 2 to 3 years. Indian EB3 is in worst situation but only for past 2 years and before that everything was current. For that also most waiting persons filed I 485 because of July VB issue. In my opinion EB3 PD will be backdated up to 5 years.

    Also there is no legistrative activity in Congress about any immigration issue. Always skil bill comes in limelight when congress is in Session. But everyone knows that skil bill is asking too much in H1b and immigration numbers because of exemptions and it will be very difficult task. But no one in pro immigrant community is ready to compromise on numbers. When Congress tries to curb the abuse of H1b even pro immigrants are opposing the bills without any suggestion of any alternatives. If some bill comes for only GC that too moderate increase in numbers that will have bright chance of passing in congress.

    You should not expect any rally will produce meaningful reform. It has to be proved that additional immigrant and H1b numbers will produce more jobs and it should not create unemployment in americans.Just sufferings of gc waiters is not enough. My opinion is Rally will be used to show strength of IV and may educate public and Congress. But anti immigrants also doing Similar Campaign(not big rallies) by negative points of immigration. The same congress till the end of 2008 and I doubt they will consider any immigration issue till new congress comes in 2009 that is not too far from now. But it is always good to try all the time.
    Before any reform comes most IV members may get GC.


    This has been talked over and over. If you feel that the wait times are not INDEFINITE, great. Please go ahead, lean back and relax. If you know everything about whats going to happen, why even bother about Immigration issues or IV? Its not about showing off muscle. Wake up! Its about different people from different categories and countries stuck in a totally capricious system. Its about the system, arcane and antique law. Its not about any one particular person's PD, his/her category/country. There are people who are in EB2 with PD's 2002 and have not got their GC yet. Dream on and Smoke what ever you want.

    I am in a similar situation and have a very simple question. Can I port from EB3 to EB2, while on EAD? I do not have a valid H1. AFAIK porting needs re-filing a labor application, hence the confusion.

    Thanks for the pointers.

    In my case I don't even know if it is namecheck that is blocking my case. So far my guess is that it was just the huge deluge of July 2 applications under which my application got stuck. But now that they have opened my application and mailed an RFE on Oct 22, at least I know that some IO is processing my case. Right now I am eagerly waiting for the RFE details. My law firm(FDBL) has not received it yet. I am pinging them every other day.

    To answer another question from another poster, yes, I have been with the same company since 2001.

    Sorry! to hear about RFE..I hope your RFE is simple to answer...

    Most of the state colleges, (In my case, none of the state colleges), including under-grad and medical schools, will accept application, if you do not have GC/ US citizenship. I tried, wrote letters, but of no use.
    You can apply and get admission in private college, which of course cost much more.
    Also, we were not able to take any federal loans.

    Hi Dinesh, in your quote above were you intending to say that most state colleges WILL NOT accept applications if you do not have GC/citizenship? So to attend a state college you NEED TO BE a GC holder/citizen? If that is the case how come lot of international students come here and attend state colleges for MS/Phds and get assistanships/fee waivers?

    You cannot change employer and keep I-140 if you have not filed I-485 yet. You will have to start the GC process anew if you change the jobs now. So wait untill you apply for I-485. Wait 180 more days after that and you are free to change jobs if your new job is same or similar to your current job.


    As you started your GC just now, it's OK to switch the employer and start the GC process once again. If your new employer is ready to start GC process and ready to offer good package, go ahead and take. Don't even think about any other things. If you have to pay for your GC, you need to work on the pros,cons and expenses.

    As the dates retrogressed so badly, there will not be any difference if your PD changes by couple of months.

    I received an RFE from NSE on Sep 2nd week asking me to prove that I have 5 years of experience after completion of degree.

    Country: India
    Date of Joining with current employer : Jan 2006.
    PERM Filing/ Approval Date: Aug 2006.
    I-485/ EAD filing Date: July 2007.
    I-140 RFE received date: Sep 2007.

    The RFE reads as follows.

    ---------------------------------------
    "Please submit evidence which establishes that the beneficiary had at least five years of experience as a software engineer after receiving his bachelor's degree but prior to August XX, 2006. Since your evidence does not indicate that the beneficiary received his bachelor's degree until 2002, this does not appear possible.
    If the beneficiary received a degree prior to 2002, please submit a copy of that degree. A certificate that he had completed a coursework for a degree is not a degree."
    ---------------------------------------

    This is my history.

    I did my 4-year Bachelor's of Technology in Mechanical Engineering in Dec 2000. My diploma (degree certificate) has two dates on it. December 2000 and June 2002. The December 2000 date is mentioned in Big letters as its the completion of my final semester exams. The June 2002 date was due to taking one of the supplementary exam of one subject of one of my previous semester .
    I was hired by a software company in December 2000 and I have work experience ( as well as experience letter with 40 hours a week) as a software engineer from Dec 2000.
    But now according to the RFE, INS is not ready to count that experience from Dec 2000. I finished my school in Dec 2000 and never had to go to the school except for one exam in 2001 and another one in June 2002. (In my university, examinations are conducted only once in 8 months). I checked my transcripts that were sent along with I-140 and it has the dates of 2001 and June 2002 due to the examination. Its present at the bottom along with Main date of Dec 2000.

    I had placed the course completion certificate from my college along with the I-140 application and it looks like INS don't take that info consideration.
    I am in deep trouble now. Your help is greatly appreciated. My attorney didn't find these issues before filing the labor certification on EB2.

    The newspaper ad given before filing the labor certification asks for Bachelors degree and 5 years of experience.

    Please help me by sharing your experience(s) as well as comments. I will really appreciate your time and effort.

    My only concern is to save my labor certification so that I can keep my I-140. I read in some threads that INS gave an option to convert the case as EB3. I would have been very happy if I had received that option. I requested my attorney for EB3 conversion at this point of time. He said its not possible as conversion needs to qualify the beneficiary for both categories (EB2 as well as EB3). He added that the labor certification was done on EB2.

    I have applied for my I-485/EAD in July 2007. The EAD is about to come but I have this biggest problem of I-140 RFE. If the I-140 is denied my wife's EAD will automatically get revoked which will stop her from working.

    Some of my friends recommended to respond to the RFE, file an MTR if I-140 is denied and an appeal if MTR also doesn't work. They also suggested me to file a new PERM application as a backup. All this works as I don't have any plans to switch my employer till I receive my final green card. But my wife will be in trouble as she can't use the current EAD. An attorney friend of mine is saying that those actions (MTR/ Appeal) will only keep the labor and I-140 on hold/pending, but won't keep the EAD alive. Is there a way I can keep my EAD alive by those motions?

    Is there any way I can get this RFE cleared and have my I-140 approved? Can I keep my EAD alive somehow

    this is indeed problematic. I hope someone comes up with a good workaround, the only thing I can think of is:
    - start another PERM asap.
    - go ahead and respond to the RFE trying to explain what you have mentioned here. It'll be hard as technically you got your degree in 2002 (ie. you completed all the rquirements and got the cert)
    - if you get a denial, file an appeal, that buys you some time.
    - during that time hope your new I-140 comes through (for the PERM you are starting now) and then interfile that I-140 to your existing 485

    I dont know if doing an MTR on the 140 will also keep your EAD alive...

    as far as i know, you cannot avoid that scenario of the employer withdrawing I-140. You can speak to them, but there is no way you can guarantee what they do. Your boss may agree but ur corp lawyers or HR may have different ideas.

    just make sure u document everything including ur ac21 request to uscis. mayke sure u have an attorney on record who will file ur ac21...if u want to be supersafe.

    as long as u have the documentation and correct letters from your company, even if they have a rfe on ur case, u can provide documentation...if they issue a noid or deny ur petition, ur lawyer can help u file a mtr (motion to reopen/reconsider) and resolve it for u.

    i am not speaking from personal experience but from what i have been reading on the forums for a few years now.

    on the plus side u will have hundred if not thousands of ppl invoking ac21 in the next few days...so uscis will be well aware of the law, clauses, etc when it comes time to adjudicate urs.

    There are many people who would just run away from effort when doubts are raised and since people of afraid of being punished for just advocating a public policy or writing a letter to congress in the first place.     You may admire them as much as you want but fact is these are just "glorified" bodyshoppers. I meet many workers from these "great" companies at my workplace and see them being treated just as "low cost alternatives" and nothing else by this huge financial company in NY/NJ area. Because of their (INFY, TATA, Wipro, Satyam) "low billing rates" these guys cant afford good lifestyle. And back home in India INFY and TATA CEOs make billions and talk BIG. I've not met any TATA, Satyam guy here who is happy with their employer. They just hate their employers and always looking for a change. I wonder where they stand in terms of employee satisfaction? They treat their people like slave and send them as low cost labor. Not only that - they exploit US immigration rules and make use of L1 to keep their people long term at cliant place when they dont get enough H1.

    No difference from local bodyshoppers! Dont think they are great companies. You may say "you folks are frustrated with these companies". But this is the fact. Period.

    I think this thread is hijacked. I will also join the band :p I work for one of these companies (SWITCH - Satyam, Wipro, Infosys, Tata, Cognizant, HCL) and came on L1, became H1B and on the path of GC through the same company. Some of what you have said is correct that the employers are not paid same as what IBM US employers get (and of course what some consultants get). Some of the issues are working off-late hours and coordination effort etc.

    The positive side of these companies is
    1) Career advancement - One can really grow into lead and managerial positions if they have the aptitude
    2) Technical Career Paths are there for those who are technically inclined.
    3) Benefits - There are good benefits which usually may not be there for those working for desi-consultants
    4) Support from a large pool of knowledge - If I face any issue, I post it in my company help forum, there will be many responses,some real good ones within a day.
    5) More job security - companies are not yet used to down-sizing. In hard times, there could be some salary rationalization (which I think is OK - better than losing job) and increased utilization (again doesn't mean more work from individual it means optimal bench strength)
    6) Growth - While it is debatable whether it can sustain the rupee strengthening or not, unless the company 's strategy is very narrow, nobody outsource for the cost alone...Many are simply build-or-buy decisions, and based on core-competency and risk management. Deals that are struck these days are multi-year, multi-million dollar ones which will provide guaranteed business over a long periods.

    Coming to those who come on L1 or H1, most of them want to get an opportunity to work at client location to better their perspective (apart from Dollar conversion). Nobody comes here by force. Their priorities are always different than most of the forum readers' Their choices are also limited. Some leave as soon as they come here (I personally interviewed at least 10 folks last year who floated their resumes as soon as they landed here), some want to go back after working here few years, some switch to H1Bs through desi-consultants, thus enter rat race, some try to grow here in their company on long term basis.

    Hope this clarifies few who pity SWITCH employees..

    Again these are not "glorified" bodyshoppers. It is a very wrong impression. I am a manager at one of such companies. We have highest regards for our personnel, we strive hard to make a big difference, we compete with other service companies like Accenture, IBM and EDS, have high client focus and we feel proud about it. Never in ANY meetings or strategies we keep our employers' interest below anything.

    This is the same argument used by anti-immigrants.

    I am a nurse so we better flood the job market; don't you think so?

    Now how does that makes me an anti-immigrant :mad: :mad: :mad: . I am ofcourse happy that so many of my friends here are going one step further in getting GC. Something is better than nothing. But, suddenly more than 1/2 mill people getting EAD will have some effect on the market. People(on H1B) loosing jobs after 3-4 months may find themselves in a difficult situation to get a job.
    I am on H1B myself, how can I ever be an anti-immigrant ?:) :) I was expecting a little bit more permamnent solution and not a band-aid solution as somebody pointed out.

    It is easy to visualize a scenario where an activist Latino american citizen, probably acting under guidance by La Raza, purposefully fails to establish his identity and gets arrested. Imagine the media circus once the news outlets find out that an American citizen was detained due to this law.
    I think it wont stand for long.

    It is correct that a MBA will prepare one for mutiple fields, however the question being asked is specific for IT professionals who are trying to jump into management.

    I believe the confusion is there between MBA and PMP, because some of the folks are at a juncture where they want to make a quick buck and are also thinking of career advancement.

    Yes for a quick buck you can get a PMP and move up the ladder, but for long term sustainance you need MBA for senior management posts.

    I guess it does make life more exciting when we make decisions without thoughts to the past but I prefer learning from others experiences. Rather make new mistakes than do something stupid that 3 other people had already done.
