From some of the posts I found that some folks are concerned that it took so long to find and recognize talent from India at Oscars. Some felt Richard Attenborough's and Danny Boyle's movies got recognition whereas other Indian directors are not reaching the pinnacle.
Even though OSCAR is recognized globally, it is an American movie award (Yes there are exceptions in some categories of OSCAR -- such as Foreign Movies etc). So, because of that reason, normal Indian and other Foreign movies are not eligible to be considered for the OSCAR. It is the same reason why Hollywood movies are not getting awards at the National Film awards in India!!!
What I meant was, a particular movie has to meet certain eligibility criteria to be considered for the OSCARs. So, if a Bollywood movie directed by a Bollywood director meets those criteria, that movie can compete in the OSCARs.
So, In essence there is not that much discrimination at Hollywood - I found Hollywood as a place which embraces all cultures and beliefs. Hollywood is the real catalyst for the American melting pot theme.
This argument is not a personal one targeted at anyone. So - Please try to avoid personal level attacks - Instead criticize the argument - that will make this argument more interesting!

Major Rules for consideration at Oscar are:
1. All eligible motion pictures, unless otherwise noted (see Paragraph 9, below), must be:
a. feature length (defined as over 40 minutes),
b. publicly exhibited by means of 35mm or 70mm film, or in a 24- or 48-frame progressive scan Digital Cinema format with a minimum projector resolution of 2048 by 1080 pixels, source image format conforming to SMPTE 428-1-2006 D-Cinema – Image Characteristics; image compression (if used) conforming to ISO/IEC 15444-1 (JPEG 2000), and image and sound file formats suitable for exhibition in commercial Digital Cinema sites,
c. for paid admission in a commercial motion picture theater in Los Angeles County,
d. for a run of at least seven consecutive days,
e. advertised and exploited during their Los Angeles run in a manner considered normal and customary to the industry, and
f. within the Awards year deadlines specified in Rule Three.
2. Films that, in any version, receive their first public exhibition or distribution in any manner other than as a theatrical motion picture release will not be eligible for Academy Awards in any category. (This includes broadcast and cable television as well as home video marketing and Internet transmission.) However, ten minutes or ten percent of the running time of a film, whichever is shorter, is allowed to be shown in a nontheatrical medium prior to the film's theatrical release.
-------------------------------------------------------------------------------------------------------
“Slumdog Millionaire” would have excluded from OSCARs if it went straight to DVDs as per the initial assumption of its producers. Fox Searchlight rescued this movie and because of that it met all the rules above and included in the OSCAR competition.

The broken system is causing a reverse brain rain, right? Well How about we:
1- Each one of us buys 10 bath tub stoppers (you know, the stoppers you use when taking a bath, to stop the water from going down the drain) and mail them to Congress, Media, USCIS, etc- With a letter "Please stop the self-inflicted U.S. Reverse Brain Drain, already 100,000 highly-skilled have left, stop the 10-year green card delays for LEGAL highly-skilled immigrants that is pushing them out of the country in frustration and lured by the boming economies of their home countries. Retain these highly-skilld immigrats that the U.S. needs while American universities train more Americans in the sciences, math and technology that the country does NOT currently have and desperately needs to retain U.S. global leadership and competitiveness"...or something like that
2-At the same time, we ALL send WHITE roses to Congress (Roses are now IV's trademark, we are known for them and the peace they mean, and roses should probably be on IV's logo too) Attach same note
THAT will send a strong message!!! (trust me)

What do you mean by upgrade to premium? I dont think you can change the option by simply upgrading. You need to file I-864 to change to consular processing.
There are a few options:
1. If you have chosen consular processing, ( I am guessing you have not), you can file I-485 and amended I-140 at any time PD becomes current.
2. If you chose AOS on I-140 and the I-140 is approved, some consulates accept attorney certified I-140 provided you pay the fees usually payable to NVC. Expect 3 months of delay in getting an appointment though.
Pros & Cons:
Consular:
You get your GC as against EADs endless loop.
You have to be with the same employer for atleast 180 days since the time you get your GC and you enter US using your GC.
AOS:
You and your spouse both get EAD. NO need to travel to foreign country.
You need to wait 180 days from filing 485 to change jobs (assuming 140 is approved, if not the case is more complicated).
More time consuming and longer duration.
The lawyers here will vouch for I-485 as it means more revenue for them. If you have a stable job where you are doing good and you are counting to get a promotion, etc go for consular processing instead of getting stuck with 485 process.
Thanks for your response.
I've a pending i-140 and I had opted for CP at that time (the lawyer adviced this as its easier to switch from CP to AOS)
I can upgrade i-140 premium to get an approval asap and then proceed with CP, but I'm not sure how long it will take for the CP process (any ideas?), I'm concerned the PD will retro again and I'll be stuck again with nothing in hand.
From your response CP looks like a better option but its too risky in my case correct?

We got a partial correction on their on line article at the bottom which was just added after our e mails started hitting their inboxes. It is good that they realised their error. A pity it did not make it into their print edition.
See at the bottom under Amplification.

HI,
My wife got her h1 approval in Oct 2007. She hasnt been on any project, nor has she received any stubs. i want her to convert to h4 again as she is pregnant. If she goes to India to get her H4 stamped what docs does she need? will there be any problems?

The requirements for the position shouldn't exceed SVP time levels for the job zone to which the position code belongs - that's all I know. If the position code falls under zone IV or V you can require MS.
I still don't understand how BS+5 qualifies for EB2. If the position code falls is in zone V, BS+5 (7 years of SVP) would be a "normal" requirement, but isn't EB2 only for people with advanced degrees AND positions that require the advanced degree?

Most of the time, consultant works at a lower rate because he doesn’t know what is being paid to the vendor. If you know what is being paid to the primary/preferred vendor, and the difference is high, you just pick the phone and have a straight talk. Preferred vendors negotiate. You can squeeze them pretty hard. I had done to $5 margin in the past.
No vendor wants someone to leave a job, tell the client that he is not being paid well because the vendors are keeping a lot of money.
Preferred vendors are now occasionally working on small margins (believe me $10 is VERY good for them, if another middle layer is finding the candidate for them). They take high margin when they when you go by salary and if they think they can find cheaper guys easily.
On the other hand, there are middle layers, who are suckers and will try to keep the high margin. But you can deal very assertively with these middle layers because these are small cos. Never sign non compete with them. You can even chnage them and in fact your final preferred vendors can sometimes do that with you.
with vednros, go hourly instead of salary. I don’t think there is risk, because if you do not have the job at client, you will be fired any way.
With Desi cos holding your H1, I think margin is not the issue. Just have a hourly rate negotiation (no salary negotiation) because in future you can command more rate. If you have EAD, desi co will be willing to work on very small margin because they know you are an unchained tiger now and can run anywhere.
There is a cut for managers, but is not that cut and dry....generally in kind than in cash. Managers favor their favored vendors, but if you are a useful person in team, he will not come in a way. In fact, you can try to use his relationship with the vendor to your advantage. Relationship mgmt is the name of the game (not just plain performance).
If you are billed $180 and paid $85k, here is the strategy:
If I was you, I will set up a conference call with my manager and vendor rep, and tell both that I might leave because vendor is keeping a lions share. Believe me, no vendor and manager would like to have this dialogue in open and your vendor will increase your rate by calling you in advance.

I am not sure about this but one thng can certainly happen with Admin Fix.
Porting of applicant who have stayed long enough in (EB3 to EB2). EB3 15 years experience and still counting and stuck and uncertain porting rules and AC21 doesn't make sense at all.
Or
AC21 rules or some other fix giving relief to people stuck in GC unnecessarily.
USCIs can make these fixes but they dont want to do it. Its simple
..and why not EB2 to EB1 and EB1 to EB1-NIW..and so on...
