unfortunately, we cannot go back to our home country, as unemployment rate is insanely high, we would be both without jobs, no place to live, another civil war may break any day now and we do not want to go through all that all over again...

one way i am thinking of doing is asking for a EVL from the new company with the same kind of job description. 10 years ago, all these laws (to be in the same job description was having some meaning , people used to get GCs in less than a year), but these days it takes anywhere between 5-7 years, and how can uscis expect someone to be in the same description working for 7 years. it just doesnt make sense when you want to be competitive in the market.

You don't need any support from your ex-employer for your wife's 485. But you need your 485 receipt for this along with the affidavit and marriage certificate.

Hi,
In my case, it was concurrent filling on July 02. I received receipts of I-485, EAD and AP early Aug. However, I never received receipt for I-140. My Lawyer check the encashment of checks and found the LIN number. According to that number, my case was approved on Aug 30th.
However, we never received any receipt or notice of approval for my I-140. Thus, not sure, if everything is correct. My lawyer has promised me to check with USCIS guys and get more concrete information soon.

We have our own agenda as they have theirs, But We can ask them to
correct information which is not correct. Otherwise we will create a parallel
graph and point their mistakes and they are free to correct ours.
If someone looks up on net, he/she should see correct information, If
someone searches numberUSA it should also see our site with correct graphs.
We should never fudge number to prove our point, Because we are real people with real issues, which affects our lives in real way ... not idealogues .. where ideaology is above everything(even nonrefutable hard facts or humanity).
I request people on this forum to be careful what they write, We should only
question the incorrectness of the statment without becoming personal , dis-respectful or vengeful, because our fight is born from need not from hatred.
All of us need to also further our qualifications and skills to show ourselves in best light and be able to show our achievents in constructive way to get the best deserved treatment from american lawmakers.And beleive me they

My 485/EAD applications were mailed on July 5th. and received on July 9th. by F HEINAUER at NSC.
I have not received a single notice and checks were not cashed.
I called customer service today and the they told me to wait 90 days.... :eek:business days!!!

On the same lines, one of my relative was also denied entry into the US at the Mineapolis airport. She is a widow, 70 years of age, and used to come here to visit her only son and daughter-in-law and their son, since last 6 years. She used to stay for 6 months during the summer time (April to Oct.) and then 6 months in India. But this time when she came here they denied her entry suggesting that you have a pattern of staying here since last 6-7 years at the same time of the year, so you are doing something illegal!!!!......
Now how can one explain this???....70 years of age, a widow and her only son and daughter-in-law earning together earning atleast 6 figure income, a house of their own.....never went out of status, never extendend her stay beyond 6 months.......doing something illegal? and that too they said that they 'suspect'!....no proof whatsoever.....but according to law, she had to go back....this sucks big big time.

Online information say Indian passport renewal takes around 10 - 15 days but it is usually done much quicker. I received my passport in less than 2 weeks(7 business days if i remember correctly) from Chicago, offcourse i mailed all documents.

How long have you been on H1? Can you find a new job and transfer your H1 to a new employer? Your employer is legally bound to pay you the salary listed in LCA for H1. You do need to show evidence that you worked for your employer.
Collect all evidence that you can about your employment, salary, contracts, etc. Have copies of timesheets, all email correspondence, pay stubs, any written evidence about how your employer did or did not pay you. Keep evidence of you actually working during the time, copies of approved timesheets would be very helpful.
I am not sure how much money is in question here, but I would talk to a good attorney who understands immigration law as well as employment law in your state. Labor laws differ slightly from state to state. What state are you from?

I had a OHIO driver's license for last 5 yrs and moved as a consultant. I worked in Memphis,Texas and PA. I did not change my OHIO license in Memphis and Texas as the duration of the projects were short. Finally I did change to PA drivers license. When I did change to PA driver's license ,I took with me my apartment lease copy, Telephone bill, H1B-I797 and OHIO driver's license.
I was able to change it to PA driver's license. Maybe if u show more supporting documents , or go to another license bureau in Maryland they will change the license for u
