Here is the answer would you hire me now :D
When several operations occur in an expression, each part is evaluated and resolved in a predetermined order called operator precedence. Parentheses can be used to override the order of precedence and force some parts of an expression to be evaluated before other parts. Operations within parentheses are always performed before those outside. Within parentheses, however, normal operator precedence is maintained.
When expressions contain operators from more than one category, arithmetic operators are evaluated first, comparison operators are evaluated next, and logical operators are evaluated last. Comparison operators all have equal precedence; that is, they are evaluated in the left-to-right order in which they appear. Arithmetic and logical operators are evaluated in the following order of precedence:
Arithmetic (Exponentiation (^),Negation (-),Multiplication and division (*, /),Integer division (\),Modulus arithmetic (Mod),Addition and subtraction (+, -),String concatenation (&))
Comparison (Equality (=),Inequality (<>),Less than (<),Greater than (>), Less than or equal to (<=),Greater than or equal to (>=),Is)
Logical (Not,And,Or,Xor,Eqv,Imp,&)
When multiplication and division occur together in an expression, each operation is evaluated as it occurs from left to right. Likewise, when addition and subtraction occur together in an expression, each operation is evaluated in order of appearance from left to right.
The string concatenation operator (&) is not an arithmetic operator, but in precedence it does fall after all arithmetic operators and before all comparison operators. The Is operator is an object reference comparison operator. It does not compare objects or their values; it checks only to determine if two object references refer to the same object.
....An experience guy might find it difficult to answer questions like what is operator precedence? ....

Great to hear that the event was a success. I was one of the volunteers who had the oppurtunity to call CA members and I just have one suggestion. Please update your profiles with your latest email and phone numbers. Of the 25 people I called, atleast 5 or 6 had incorrect phone numbers. One even went to a fax number. The intent for IV is to reach you quickly in such case but looks like the intent for such members is 'do-not-disturb'.

I called the 800# today bec the TSC IO told me to check back after45 days and now I was told to wait for 90 days bec of the JulyAug backlog. After I conversed with the IO I told them what if the application is lost , should i be refiling my 485 , since the deadline is Aug17, so she transfered me to her super wiser and he looked for my name in the system and told me there is no update so far and he is placing an inquiry and that will take another 30 days and there is nothing else he can do in regards... And the wait of 30 or 90 days is way passed the Aug17th deadline.
I think USCIS should honor resubmitted application passed Aug17th deadline if we have to refile our I485 due to lost mail based on Tracking conformation from FEDEX which have the Signature conformation of IO when they received the mail?
There isn't lot of time left if I have to refile my 485 application , I have to call my lawyer to get the paperwork ready, Employer for the job letter and not to mention the Doctor for the medical ,I don't even know if he will issue a duplicate I693 or i have to get all the test redone ?

Update on AILF's Legal Action Center Visa Bulletin Litigation (Updated 7/10/07) Posted 2:45pm
The response has been so strong that currently we do not need any more potential plaintiffs who submitted an adjustment application for receipt in July, unless the individuals have an unusual situation or especially compelling facts, such as an aging-out child. At this time, we also would like to hear from the non-filers -- people who did not and do not plan to submit an adjustment application for receipt in July but would have done so but for the DOS and USCIS actions. These individuals will represent a separate class of plaintiffs. And wed like to hear from more other worker adjustment applicants who applied in June, even if they have not yet received a rejection notice. These individuals will represent a separate class as well.
If the lawsuit is successful (and we fully expect it will be), the court will certify classes, and all people who meet the class descriptions will receive the relief the court orders. The class members will not need to sign up with AILF to enjoy those rights.
Regarding non-filers As our July 7 InfoNet update explained, and as we explain in our FAQ, we will include a class of people who would have submitted their adjustment applications for receipt in July, but for the governments actions. The government may try to, or the court may want to treat this class differently from the class of people who submitted applications for receipt in July. Our aim is to do the best possible for both groups.
How soon will we file the law suit? Very soon. It is not easy or quick to prepare class action litigation involving numerous people and numerous claims, but we are working quickly because of the urgency of these events for so many people.
Injunction? AILF knows many people want a quick resolution, as do we. A temporary or ill-conceived order might create more chaos and confusion than we saw in late June / early July. And the government presumably would immediately appeal, creating even more confusion about whether applications were being accepted. By contrast, we intend to seek an injunction that will be forward-looking and will not create another crisis situation for AILA members or the government.

Just to shed some light on the mortgage scenario -
Bank of America approved me for a mortgage yesterday - the rep specifically asked for the Citizen/Perm resident question, I told him that I have a valid work visa - he asked what kind - I said H1B. He looked up my credit histoiry and approved me right there. At the end of our 30 minutes long conversation, I asked him to confirm that H1B is not an issue - he confirmed that it wasn't - as long as I have sufficient funds in my acccount, a good cash flow, and a "very good" credit history.
The subprime mortgage industry is on the brink of collapse - due to all those foreclosures. These institutions have had a pretty relaxed lending schemes - especially for the intereset only and no-down payment ARMs.
Just to clarify on all the confusion:
If you are legally here i.e. on H1B yu can have any account and any mortgage. I can pretty much vouch for it because I am one of the persons in the bank incharge of enforcing the credit laws. The only requirement while giving a mortgage is what kind of credit scores and history you have. BOA is quite conservative in giving out loans while someother smaller institutions are not so conservative and hence the rejection from one and acceptance by the other.
For giving mortgage to illegals I do not know any reputable institution doing so. Yes there is always the grapevine.
I recently travelled to Delhi from SF using British Air in Dec. I chaged from Terminal 1 to terminal 4 while going and reverse while coming. Nobody asked for any visa, as far as I know it is not required. It was not required before then the requirement came in and now it is no longer there.
But I do have a valid visa on my passport.
About Hongkong it takes approximately 5 minutes to get a 15 day visa and the process is very smooth.
Singapore does not require any visa.
No visa for Germany, Middleeast and most of the East Asian stops.

<If anything like out of status or unauthorized employed happened before your last legal entry into USA (whether is more than 180 days or less than 180 days) IT DOES NOT MATTER and you can adjust status. You are fine. What's important is that "out of status" and "unauthorized stay" periods must not happen after you last entered USA and after you filed your 485 - and if it does happen, then it should be less than 180 days.>
So, logiclife, going with your above statement, I don't have any problem with my adustment of status? My last legal entry to the U.S was Mar, 2006. I applied for AOS in July, 2007. Can you point to any USCIS memo/documents stating the above facts? I was out of status in the year 2001 (more than 180 days).

Dont do character assassination of EB3 applicants. EB3s who now have qualifications/job for EB2 should definitely try to convert over to EB2. EB3s dont listen to people like these. Its the same mentality which opposes eliminating country limits; more over this same mentality which opposes EB reforms.
Grow up
Trying to stop an EB3 person who spent more time than you in GC queue and has qualification for EB2 is just insane.
Hi Coopheal:
With Due respects to your Seniority and Agony/ Frustration being retrogessed.
Standard Companies donot opt for having two I140s approved for a particular employees which is a "Logical Fallacy" of EB concept. Leave alone Rat Desi Companies.. They can do anything and turn the boards off..
If your arguement is right: first you have to stop L1s getting Gcs in less than 10 months.. (on an average). Porting EB3 to Eb2 is a big junk and disrepct to the EB2 Qualifier. Now, Qualifying Eb2, if you feel, is not a big deal, why the companies did not preferred it out for Eb3s in first place because lack of Job Requirements. (infact, this portings have to be highlighted to USCIS as Junk technique and illegal).
So the whole arguement doesnot workout. Soon, wait and see Portings would bestopped, with Desi companies messing itaround like Approved labors (infact, it isa refined version of approved labor scams).
Please donot jump on me.. its a waste of time.. But the logic holds good EB2 Vs. EB3. If allowed, People may even qualify for EB1, (People would work it out also sooner or later) Let's respect each other profiles.. and its a matter of time we are all there.
This is my Honest Advice.. Trust me. I am a 2003 eb3 victim.. No way to jump lines.. its inhuman.
Thanks,

I absolutely agree with you. I can't imagine how a person of Indian or Chinese origin can blame themselves of this retrogression. To me, it is a reflection of poor self esteem.
The bottomline is that we are here because we are needed here. We have the privilege to apply for green card in return for the work we do. Country quota does not make sense in employment based immigration. It is an unfair practice which has to stop someday.
very good point. Such low-esteemed people will start blaming their parents for retrogression. Why they gave them birth in first place. If they wouldn't have been born, no retrogression. See its EZ!

singhsa...all number and predictions get thrown out of the window when it comes to indians. we find the most innovative ways of jumping ahead in line.
i remember a few months back I had checked on and there were approximately 200 people with an earlier priority date than mine 09/2005. now there are 700.
I agree the BEC freed up many people but a bulk of these cases are priority dates porting and labor substitution.
so you can download and analyze the labor certfications from flcdatacenter (or look at my earliest posts..when u search posts by user) but the fact of the matter is that there is no predictability to the queue because we specialize in jumping ahead

I had a situation last year when I was flying Thai airlines to Bangkok from Phoenix. Thai airlines allows 70 LB per luggage and 2 luggage per person. However, since there is no Thai flight from Phoenix to Bangkok, I had to fly United from Phoenix to Los Angeles. Here is the problem. Since I was flying international, I thought United would allow me to take 70 LB because that's what is allowed on Thai but they didn't let me do that. They said that it was a domestic flight from Phoenix to LA and would only allow 50 LB. They asked for another 1000 dollars to check in my luggage to my final destination, Bangkok. I, of course, didn't want to pay that kind of money so they checked my bag only up to LA and I had to pay about 150 bucks for the extra 20 LB weight. I then had to claim my luggage in LA and then re-check in with Thai and I didn't have to pay any extra money aside from all the hassle of check-out and check-in again.
Is this normal procedure when you are flying international? What's the use of Thai allowing 70 LB when you can't do that with your connecting flight or is it just United trying to squeeze some of my hard earned money? What's the best way to avoid this kind of situation again aside from only taking 50 LB? Is there any clear guideline on connecting flights?

I agree. Let's forget about this misunderstanding. As to the current topic, here is also Greg Siskind's opinion (his blog) which I just found:
On the Visa Bulletin, DOS' Charles Oppenheim has the difficult job of trying to move the priority dates exactly enough to get the maximum number of visas issued in the fiscal year. In years past, hundreds of thousands of visas were wasted because of forecasting problems. It's one of the reasons behind last summer's mess. There is no grand conspiracy on Mr. Oppenheim's part to try and disadvantage any group or deliberately shortchange the immigrant community. So I'm going to assume that the moving around of the numbers was done with the goal of squeezing out every last visa of the 140,000 available.
There probably really isn't any conspiracy or wrongdoing on DOS's part with regard to the last bulletin, and I do hope they do their best to use visas efficiently so that everyone becomes Current sooner rather than later. Maybe they should just do a better job at explaining information and educating people, so that one group doesn't think they're becoming disadvantaged and start doing foolish things.
