Well - though white racists may oppose - anything related to economy and development does go through.
I personally think that if this proposal goes through - EU will be the next melting pot.
Racism is there everywhere, we find it in US also, even in India, you find caste system and inter state racism. With rising opportunities, such things may not really be visible especially in places where there are free zones.
Does anyone has more info on this?
People are always prejudiced against something. If it is not race or ethnicity, it's country of origin, province of origin, class, gender, faith, or whether you are poor or rich. Even poor people have prejudices against rich people. And people tend to group with people who share their prejudice to fight against those who they are prejudiced against. It just makes life miserable for everybody.
But at least when the two groups who are against each other are about the same in size, you will feel less pressure. If you are among few foreign professionals working among a largely native population, you will feel a lot of pressure.

I think that everybody has the right to express their opinion.
Anything else is sensorship
good luck to all
That is true. But I would rather bicker/argue among ourselves in our closed community and not in front of the public. I withdrew my post because singhsa3 is inviting media and other outlets to view this poll. I see no good coming out of washing our dirty linen in public.
I am neither convinced by singhsa3's arguments and nor do I buy into the whole "potential-to-buy-houses" angle (and I got red-dotted for all my previous posts, but I don't care), but if he's willing to take the efforts because he believes in what he's doing, then I don't have to be the all-freedom-of-speech guy.
So long as singhsa3's not pledging that I and my wife will buy our house #2 and house #3 only because USCIS gives us green cards, I am fine with continuing with my life and work. :)

:)Anything can be done without an attorney....the issue arises if USCIS or DOl comes back with a question. Best thing is to put in some money, pay an attorney and let them handle it.
Most of the immigration stuff is simple if everything is clean....but you never know.
Why pay for an attorney unless your case is complicated?
Its straightforward and you can do it on your own.
Again, if your case is a bit different and needs a lot of documentation, you would need an attorney.

At times we forget who we really are - Immigrants. Of course when the going gets tough, we will be the first ones to get hit. Why is that even under question? Do we expect any country to first worry about immigrants and then worry about its own citizens? I don't think so... We don't have the same rights as citizens or even GC holders, rightfully so. There are times when we will be discriminated against in the most polished way possible. For e.g. the President while giving out the TARP money to the banks mentioned that any banks receiving the loan can't hire any foreign worker (I don't remember the exact verbiage but it was something on these lines). Did people on H1s or other temporary work permits not pay taxes that consituted a portion (however small) of the TARP money handed out to the banks and car companies? So what? Some people complain about paying SS tax while they are not even eligible to receive any benefits unless they get GCs/Citizenships etc. So what? Now, all of these points can be argued in multiple ways but the bottom line is that us immigrants do have a lot of boundaries that we need to work within. Some of them are just, others aren't. Honestly, we are lucky that the govt hasn't come out with a rule yet that will send all the H1-Bs and other temporary work permit workers packing till the economy is back on its feet again. Guess what, we will all be angry about it when it happens to us, but the moment this coutnry opens the doors again to immigrants, we will be standing in the line right outisde the US embassy for new stamp.
Why am I saying all this - just to put things in perspective. As someone rightfully said earlier, filing for your GC process is an incentive by the company just like giving out a bonus - even that has a more certainity than GC. The company can anytime decide not to fulfill its obligations towards you if its not in its best interest.
Please believe me when I say that I am not writing this to lecture anyone about the realities of life. I have gone through the thick and thin of the immigration process just like all of you. I have spent countless hours thinking "agar aisa hoga, to phir kaisa hoga" (sounds filmy, I know) but its true. IMO, the sooner we understand the realities, the less painful it becomes for us...

USCIS cannot do anything on the matter. INA is clear on the AOS conditions, one of which is "An immigrant visa is IMMEDIATELY available at time of filing for adjustment of status" (INA 245, 8 USC 1225)
INA should be changed which should be done through a legislative process, not through any rule making.
Thank xbohdukc. I think, this door is also close.

The following makes no sense it is utter non-sense.
COMPANIES LAYING-OFF THOUSANDS OF AMERICAN WORKERS DONT NEED GUEST WORKERS
Please Support the Sanders-Grassley Employ America Amendment to the Tax Extenders bill
Dear Colleague:
Since the recession started in December of 2007, nearly 8 million Americans have lost their jobs and the unemployment rate has nearly doubled. In total, 15 million Americans are officially unemployed, another 8.8 million Americans are working part-time only because they cannot find a full-time job, and more than one million workers have given up looking for work altogether.
With the unemployment rate still unacceptably high and millions of people looking for a job, we have a responsibility to ensure that companies do not use temporary visa programs to replace American workers with cheaper labor from overseas.
Therefore, during the consideration of the American Jobs and Closing Tax Loopholes Act, we will be offering an amendment that would prohibit companies which have announced mass lay-offs over the past year from hiring guest workers, unless they can prove that their overall employment will not be reduced as a result of these lay-offs.
At a time when millions of Americans are out of work, the notion that we need to import labor from abroad because there are not enough qualified, willing or able American workers in this country rings hollow.
Recently, some of the very companies that have hired tens of thousands of guest-workers from overseas have announced large scale lay-offs of American workers. The high-tech industry, a major employer of H-1B guest workers, has announced over 330,000 job cuts since 2008. The construction industry, a major employer of H-2B guest-workers, has laid-off 1.9 million workers since December of 2007.
The American Recovery and Reinvestment Plan, signed into law last February, included a provision to prevent companies receiving assistance through the Troubled Asset Relief Program from replacing laid-off American workers with guest-workers from overseas.
The Employ America Act expands upon this provision to prevent any company engaged in a mass lay-off of American workers from importing cheaper labor from abroad through temporary guest-worker programs. Those companies that are truly facing labor shortages would not be impacted by this legislation and could continue to obtain employer-sponsored visas. Only companies that are laying-off a large number of Americans would be barred from importing foreign workers through guest worker programs.
If you would like to co-sponsor this amendment, please have your staff contact Warren Gunnels in Sen. Sanders office at 8-6358 or Kathy Nuebel Kovarik in Sen. Grassley's office at 4-3744.
Sincerely

Re: http://money.cnn.com/2007/09/25/smbusiness/h1b_cap.fsb/index.htm?postversion=2007092606
The article referenced above written by you has a glaring error. It states that "Last week 1,000 protestors-mostly legal immigrants-drew attention to the situation of highly skilled foreigners who want to work for companies in the U.S. by marching on Capitol Hill.
The demonstrators said that potential employees-who are needed in growing fields such as engineering and software development-are being shut out because of a lack of H-1B visas. "
I was under the impression that esteemed reporters like yourself research the facts in detail before providing such statements. That does not seem to have been the case here.
I was one of the participants in the rally held on September 18th by Immigration Voice (www.immigrationvoice.org). I flew from Dallas, TX to press for reform to the green card process which is taking anywhere between 6-12 years to process permanent residency applications. This is VERY different than H1-B which is a temporary visa.
As a participant of this rally, I am utterly disappointed to read that you and the CNN organization have completely misrepresented the purpose of my protest, thereby undermining the whole effort.
Kindly contact info@immigrationvoice.org and Immigration Voice should be able to provide you with the detailed facts about the purpose of the protest. I urge you to fix the article as soon as possible and issue a correction.

See buddy, there are some people who will cry whatever scenario they are in, and some people who will laugh and be happy in whatever scenario they are in. The key to optimism and happy life is to find someone who has it worse, and realize how fortunate you are. At least you are not having to live in the slums of India. At least you are not having your daughter breathe the polluted air of an Indian metro. At least you have a healthy family and no medical emergencies to worry about. Enjoy what you have got, not crib about what you've got.
This is what I always thank my elders and God for what I have been given in my day to day life.

May be meaning of Taliban is wrong: No, It means..someone who is seeking religious knowledge. Nothing wrong in it.
Next time you are in airport security try telling them that you are Taliban and see their reaction.
some words have sentiments attached to them that go beyond on the literal meanings of the terms. Thats where people need to be a bit sensitive. People here have invited news firms to check out our forums (someone was recently trying to get folks from CNN over); seeing handles like Taliban does not exactly help our cause... common sense, yeah?

I think this is very important, I asked in the past about it but I got no answer.
It would be OK for me to buy a bunch of flags (50-100) and maybe get reimbursed for them at the rally if somebody wants one? I get support from anyone?
We need to do this! Any ideas on how to reimburse him? How much would it be? You can PM Core and ask!

One more day to go before the end of this campaign.
Here is another incentive to make these call:
I will donate $ 5 to IV, for each member that makes these call from now on till end of the day tomorrow. I know, your hourly billing rates are way higher :) but this is what I can do for now.
I already called all the people on the list, it was easy. Office staff members were patient and friendly. Show me what you got!

That must have been a big surprise for you to see the Approval then?
I was under the impression that you'll start seeing continuous LUD's on your application before the approval.
Everyday I check my app and be disappointed that there is no LUD and wait for tomorrow.

I think the bottomline is not having a GC causes you so much general grief in life that even if you were in a perfect job on H1 and your spouse had a perfect job on H1, you would still want GC just to circumvent these issues with transit and financial institutions.
I know every time my wife or I fly anywhere, we are concerned about transit visas. Anytime you try to open an account, you are concerned. Different state DMV's act differently. Heck, even people in same DMV office in same city interpret rules differently when it comes to H1. I know ppl who have had trouble in CA getting a license because their H1 extension pending and I know ppl whose licenses were mailed to them with validity for another 5 years!

Do any of you think that the dates will move forward next month? Looking at the backlog numbers published by USCIS, I think they moved as far as they could to make use of all the available visas. I am thinking that the move next month might be only a few days or a month at the max. USCIS mentioned last month that we could expect the dates to be March/April 06 at the end of this fiscal year. Will this mean that EB2I will hold out at March / April 06 for the next fiscal year?
Interesting question. You are probably quite accurate but there still remains some hope of a few months movement:D:D

I agree!
The three prone system is in place to keep check and balances. I think it will be good idea to take it to judiciary. Judiciary can advice legislative and executive branch to resolve the problem. I think just going to that level will trigger lot of momentum.
