It would be great to have premium processing for 485s instead now that visa nos are available. Now now ... i know thats wishful thinking but think about it-could save a lot of time and money over EAD/AP/FP renewals. But then again hurts their income stream thats why they wont do it :((

Not necessary US wants the best of best to get the green card. They see variety of immigrants is more important to US and that is why they setup country limit and setup DV lottery. If they simply want the best of best, they can cancel the DV and even reduce family based and all move to the employment based.
If you really want to talk about a system in jutice, then we are looking at one applicant for each country at a time. I guess OP will not like to see this happen either.

Pre-Adjudication is just a work flow method and not a policy. There is a high chance that a pre-adjudicated case may just get an approval when the visa numbers are available. But, who knows, they may have reasons to still issue an RFE requesting employment verification based on certain triggers such as change of address, over a year since case was pre-adjudicated etc.
So we may not be able to say for certain that all Pre-adjudicated cases will be approved when visa numbers are available.

One question i have and many others like me would be interested in knowing is a clear description on how the money collected will be spent. I understand by reading your posts that it will be totally transparent and will be detailed out every week. But its more important for people to know before hand on how and why money is needed, before they can open up their purses generously.

We have posted several times that we need the money to hire a lobbyist. We got some financial quotes: it will cost up to $100K to hire a lobbyist for 4 months.
Why do we need a lobbyist:
1. We can meet Congressmen's staff on our own but it would be difficult to get appointments. Lobbyists tend to be former Congressmen or staffers with connections who can help to get apppointments.
2. With the S.1932 debacle, last minute deals were cut and the immigration provisions were removed from the conference report of the Senate and the House. We need someone who can use their contacts and find out what is going on with the bill that has our provisions in it. We need to make sure that our stuff doesn't get thrown out in another backdoor deal. During S.1932 we never got to the actual Congressmen or Senators to plead our case.
3. We need someone to tell us what exactly to tell Congressmen. We were saying all along that we need green cards because we can't buy houses, can't get promoted etc. But the one lobbyist pointed out that Congress would be much more receptive if we said we wanted to immigrate and the delay in green cards was holding up our immigration.
Does this make sense?

Thanks for the reply , let me file the H1 transfer with Employer2 now in "Premium route" with the I-140 approval from Employer1 and see if we get a approval. Once i get a approval , i think stamping it wont be an issue after 7-8 months even thought Employer1 has revoked that I-140 ?
However i want to clear even if the Employer1 revokes this I-140 my PD still remains locked - right ???

USCIS Ombudsman has released the 2007 Annual Report to Congress at link below. It is an interesting read. I am still reading it. At page 31, the question is posed:
�Exactly how many employment-based green card applications does the agency have pending?� USCIS still cannot answer that question today with certainty."
Also, per the backlog redifinition, the USCIS has about 1.2 million applications (as of March 2007) that it considers active. However, it does not count an additional 1.3 million applications in the backlog that are considered "unripe" cases by the USCIS.

The idea was to make it easy for majority folks who work in Manhattan and surrounding areas. We were also concerned that the tri state folks travel long distances and work long hours during weekdays will need the weekends for themselves and a Friday night after work must be the best time.
But, yes, based on majority of the folks's response, we plan to do one more on a Saturday, but not in Flushing, location will be decided soon.

One of my friend who is on H1 went to DMV office to change State from TX to Colorado and they gave him a case number asked him to go to MVI office for immigration status check in Denver...

"Retrogression" is the word for the rest of the year for EB3 (I). Learn it, Leave it (eat it, sleep it, drink it - whichever way you want it).
How about Dec. 2000 EB3-I for incoming bulletin? Then "Retrogression at will" as we move forward for the rest of the year. Now don't ask me how because anything is possible with (fill in the blanks).

I'm in the same boat. PA DoT wants to see visa stamp on the passport.. applied for 1st 3 year extn at VSC on 7/10, will up it to PP this week... anyone in PA got their DL renewed using RN... please specify how and where??

I am in same situation. As of yesterday, my previous employer would have revoked my 140.
I already sent the AC21 letter, there are no LUDs. My attorney says, chances that the letter may not go into the file are high and the reason we send AC21 paperwork is to keep a record that we sent. I took a screen shot of the DHL tracking info too.
Any ideas how to ensure that AC21 paperwork is getting into your file.
The answers I see on this forum is
(1) USCIS is overwhelmed with documents so mail can be trashed
(2) USCIS clerk does not know how to handle the paperwork
(3) USCIS certifying officer is not well educated about AC21

As long as you sent it by certified mail and have the return receipt, if it does not make into your file and if later they issue an RFE, you have covered your base. As long as your new job satisfied the AC21 parameters and you have the certified mail receipt, you are fine. Relax and enjoy new job.
