As somebody said above, if we r getting married after Aug 17, and if we decide not to file my 485 now. My PD is May 2007 and my 140 would be approved before my H1B is expired for the second term, and if I didn't file my 485 by then, what kind of H1B extensions would I get ?? 1 year or 3 years.
To be simple : PD May 2007
140 approved by May 2010
H1B expires Nov 2010.
485 not filed.
From Nov 2010, what kind of H1B extension I'd get (1 year or 3 years) ??

As far as I know if the USCIS issues a receipt of your I-485 they are under the impression that your GC is around the corner irrespective of PD's...Could someone please throw some light on this issue??Would really be helpful for some people to file/not file their 485's....

Could you please update your profile, like priority date, EB category etc? Is your case in TSC or NSC? Is your priority date current? what is the reason you approached congressman?
This may give us more insight into your case.
you mentioned, you changed job using AC21. SOC code same. Is there any salary difference?
Is this a consulting job?
Finally, Do not worry about denial....if the case is strong, you can always fight legally. Wait for denial letter then open MTR/appeal.

Is there any thing to do with I-140approved/pending with I-485/ead/ap processing?
This is only to track people who sent their I-485 application documents to USICIS Nebraska Service Center and received by them on the same day.

Could you also please spread the word around about immigrationvoice.org so that we may get additional members? If each one can just get one more member to join our fold, our census would double! There are 350,000 people affected by retrogression and about 500 members here. Definitely there are lots of people who haven't heard of us yet!

I have a same question regarding travel on existing AP when AP renewal is pending. According to the statement on the form, we can't travel.
I had asked this question to my Attorney and they said we could Travel on EXISTING and VALID AP even when the Renewal is pending. Make sure you have the Courier Receipts and the Copy of I-94 with you before you travel.Please take this Advise at your Risk.Contact yr Attorney to what he/she says.

I am in same situation. As of yesterday, my previous employer would have revoked my 140.
I already sent the AC21 letter, there are no LUDs. My attorney says, chances that the letter may not go into the file are high and the reason we send AC21 paperwork is to keep a record that we sent. I took a screen shot of the DHL tracking info too.
Any ideas how to ensure that AC21 paperwork is getting into your file.
The answers I see on this forum is
(1) USCIS is overwhelmed with documents so mail can be trashed
(2) USCIS clerk does not know how to handle the paperwork
(3) USCIS certifying officer is not well educated about AC21
Any idea on how to ensure AC21 paperwork really goes into your file.
Relax buddy.
As long as you sent it by certified mail and have the return receipt, if it does not make into your file and if later they issue an RFE, you have covered your base. As long as your new job satisfied the AC21 parameters and you have the certified mail receipt, you are fine. Relax and enjoy new job.

Think of it this way. Conservative estimations say that in the recent application rush, USCIS received 300K applications.
That is 2 year's worth of applications alone, not including those already at USCIS.
If you compound that with the asinine 7% country limit, and assume that there are MUCH more than 7% of that 300K from Indian nationality - I'd say you are looking at much longer than a 3 year wait on average. I'd guestimate 7 years.
The only way this will change is to support the DC rally. We are getting major traction and positive news on this and it's potential affects. Please do everything you can to come.
There are people offering to pay 100% of airfare, there are free buses being set up. There are very few valid reasons not to come!

You cannot keep GC out of equation when GC/non-GC decides your ability to get unemployment benefits, choice of jobs and many more aspects of your life.
If you leave the country, you lose the equity on the house. I don't know when you bought
the house. In the post credit bubble period, the lender will make sure you have enough equity that they are secure and you have skin in the game.
Bought my home in early 2008 on 100% financing (yeah, they had these crazy schemes back then!) before the economy tanked. So I havent put down any money. Even the closing costs were paid by the seller. For me its not an investment, but a place to live. So I am not worried about the equity. The home isnt a McMansion and the mortgage payment is manageable. When tax savings at year end are considered, it almost puts me on par with renting.
On the other hand, I dont put GC on a pedestal. I bought my home even before I had started GC process. To me it is not a life changing event like the day I was born or my wedding day or the birth day of my kid. Its something good to have for obvious benefits, but I am not holding my breath until I get it. Once again, I reiter that factoring GC into your decisions is a personal choice, and I dont do it. I am not banking on unemployment benefits or any other govt dole. Like I said, if anything were to go wrong and I had to leave the country for good, my lender will be the one taking the hit. This might not be the case in your situation and I can understand why GC would be so important then.

I E-Filed my wife's AP last weekend and promptly sent the documents. But, just now I realized that I did not enclose the passport-photos with the packet.
What do you think can be done now?
I plan to send another packet, with a cover letter stating that I had forgot the photos and they are in the packet. I also plan to enclose the confirmation receipt with the packet.
Should that be enough?

My kids didn' go to day care until they are 1.5 years old, then they want to babysitter , they started going to day care after 2.5 years. Day care is right place for kids after 2 years, because they need other kids to play, staying home is boring for them. I have personally experienced this.
